On 1-20-12 we purchased a 25' Bayliner Trophy Pro which included trailer and radio and other equipment from Matt as the seller. The boat and trailer were located at his LI home. We were told that the boat was winterized and ready for the water. Matt told us that he buys and resells boats and also works on boats for a living.
Matt stated that we were getting a GREAT Boat and Trailer. We asked Matt on the day of closing where the radio was and he said he had it just not with him and we would exchange addresses and he would mail it to us. We received an email with his request for our address and he would send it within a week. We sent our address immediately. To date we have received nothing.
Matt refuses to answer his phone and accept our calls or answer any of our messages. Our most recent contact with Matt was through WESTCHESTER YACHT SALES where he informed his broker that " HE OWES US NOTHING ". [continued below]....
Matt also claims that the trailer he sold us with the 25' boat is the proper trailer and in good condition. This coming from someone who buys and resells and works on boats. It turns out that the trailer should never have been allowed to leave his property as it is way tooo small for the 25' boat. In fact, its should only hold a maximum of a 23' boat. Furthermore, the winch arm was moved back approx. 8" towards the tongue in what appears to be an attempt to accommodate the size of the boat. What that did was place the Bow eye over the Winch and NOT Horizontal to or slightly below the winch...going on...the rear of the boat if fitted properly on the trailer should have a maximum overhang of 8" from the transom, not the 18' to 24" we have!
How would I know this..homework..I called several dealers and gave them the make and model and ID number and all other pertinent information needed for the dealers to advise me properly. All dealers spoken to stated " The trailer is for a 23' boat NOT a 25" boat and is not safe for trailering!"
We explained to Matt what was said and to go one step further I even call the Manufacturer directly. I have written confirmation of all the above direct from the Manufacturer with the additional comment that "THE AXLES ARE OVERLOADED"!
Yes, we signed a contract...Yes, we believed MATT with his so called BOAT experience and YES we BELIEVED WESTCHESTER YACHT SALES because of their experience...!
MATT says " I OWE THEM NOTHING " - WE SAY "YOU OWE US THE MARINE RADIO AND A SAFE TRAILER"
WE ARE EXPLORING ALL OUR OPTIONS AND TAKING ALL NECESSARY STEPS INCLUDING POSTING ON THIS SITE UNTIL WE GET WHAT WE DESERVE!
