I signed a month to month agreement with Max Fitness at the end of February. I paid them a enrollment fee of $40, and what I thougt was my first two months of $19.95 each totalling to $79.90. This was to have taken care of March and April which was all I wanted to use the gym for. When going over the agreement, I was advised it wasn't a normal contract, I did not have to pay an annual fee that is charged to the yearly contract members nor worry about a cancelation notice/fee since it is a "pay as you go" hint "month to month". I was never once advised that the check I gave them would be set up as an automatic draft. I went for the first two months like I had paid for and haven't been back since. Today I got a phone call from the corporate office stating they needed updated banking information because it came back to them with the account closed. I owed them $88.95 for an annual fee they tried to charge, a return fee and June's fee. After going over some details with them, they had my OLD bank account information that has been canceled since June of 2012 from an OLD membership contract that had been canceled for well over a year. Even though they had my new bank account information from the check I paid them with, they pulled up my old information withouth my consent and want to charge me a $30 return fee for their incompetence? Even though I signed an agreement, the sales rep twisted the rules & lied about everything I was signing. 

When I spoke to the lady in charge of cancelations she was slightly rude and not willing to sympathize with how horrible the sales rep was and that he had lied to me about everything. Of course she informed me they could not cancel my membership until I had paid the balance due. I spoke to the person in charge of that and she was much worse. Interrupting me while I spoke and not letting me finish explaining and just out right rude! She then went on to tell me I was going to have to pay for July even though I was canceling my membership and it's being canceled before their billing cycle. I strongly advised her I was not paying for something I am not even using because informed incorrectly about several things. I agreed to pay for June (even though I hadn't gone for May or June) just so I could get it out of the way and not deal with them anymore, but refuse to pay the $39 annual fee and the $30 return fee that was not my fault. I also advised them i would be reporting them to any and all places I can, and if I have to, I will go up the chain of authority in the Max Fitness business. 

Do not waste your time or money with their scams, lies and incompetince! I would suggest going to the YMCA or buying your some of your own equipment to do your basic workouts and do your cardio workouts in the free outside air!
