I have decided to come forward to give an update on the present situation with our court case against Moonrise Productions Inc as well as a clarification of what exactly happened (in the main lines). My real name is Cyril Delencre and I am the CEO of Else Page LLC, 2915 OGLETOWN ROAD, #1400 NEWARK, DE 19713 U.S.A. I invented the first ever website allowing dummy user to offer a genuine website as a gift, as a present to a loved one (including a real domain name & hosting plan) all this in 3 simple steps for dummies. I came up with this new idea in early 2006 and its name is www.ELSEpage.com Not being a programmer myself, I had to raise the necessary funds to hire a web development company to help me with the task. I first looked for Indian developers to do the Job attracted by their inexpensive cost. I soon realized that India was not the ideal area of the world to create innovative website ideas. I then put a proper business plan together and raised close to USD 500K and searched the web for Californian web developers and get the best professional assistance possible (so I thought at the time anyways). After having made a call for tender to most web development companies based in SF via Google, Moonrise Productions Inc, 510 Richardson Sausalito, CA 94965 USA, got my special attention because of how assertive and confident were their vice-president/CEO Gary Klingsheim as well as his wife Jenny Deng towards my project. I decided to fly to SF to meet them both so as to make sure no mistakes would be done this time with the development (rather hilarious now I know). After a few days of meeting and trying to come up with a scope, a blue print and moke up, I decided to give them the $155K job (125K + 30K Bonus), mainly based on their saying: we have done hundreds of likewise complex websites before Cyril... Who was I to doubt them? After all, they had a good web exposure and SEO, an office in center SF(OFarrell off Market St) supposedly many happy clients online and hey, I was in CA, SF wasnt I? So there I went and signed a contract with these people. Unable to remain in the US for more than 90 days at the time as a foreign investor, I went and visited my family in EU whereas all I wanted was to seat next to their development team and not reiterate the Indian disaster of them not being able to grasp the dummy proof necessity of the task. But since Gary kept telling me Do not worry Cyril, we have it under control! well work via skype you and I and all will be fine, your not in India anymore.. A few weeks later started the problems with his wife Jenny who turned out to be unable to comply with my requests or even understand many of them (I should mention that she is from an Asian culture and that made it quite difficult for her to react or analyze  like a typical American-born web developer would.) I did try to warn Gary of the communication problem with his wife, but I was walking on eggs, not wanting to upset him personally with his wife. Finally, I arrived in SF early Sept 2010 in Moonrises office premises. I had asked Gary whether he could help me find a place to rent for 2 months in SF, he said no problem! When I arrived, no place was rented, i had to stay at their place for 3 nights. I then offered to pay a rent for my office use at their biz place on O'Farrell street, 6Th Floor, San Fransisco. Gary refused saying I was very welcome. i did thank him with a gift of a brand new iPad from Apple store (I say these things cause I know Gary always present himself, as he likes to, as the nice guy who did so much for me.) Needless to say that things got hectic and fast around the office when Gary realize what a mess Jenny had done with the project during all summer. He did try and complain about me not warning him more fiercely while in EU, but he also new I really tried.. Gary started to get his hands into it but soon realized they had badly messed up with the planing, communication and especially research on the project. i was in a spot, i had to accept all increase of price, early payment to try and keep them working hard and motivated. Nonetheless, Gary did let me go ahead and spend over $200K in marketing guaranteeing me that the project would be delivered on time (1st Oct 2010). I later agreed, under threat of quitting, to sign an addendum to the contract which Gary wanted to sign to protect himself in his knowledge of the true problems that he was not communicating with me, namely, the impossibility to deliver in 2010, period! So Gary let me spend all the marketing & Advertising money + adding some to the development as a result of my - supposedly - constant  changes - when all I was trying to achieve was something that works for the customers and presentable to the U.S press, the Today Show wanting to interview me also as soon as the website would be ready (I hired a great PR team in Tampa FL). The website ended up still not being ready on the 22nd of Dec 2010 (already 2 months past delivery date according to the contract!) the project was a complete failure.. GARY NEVER MADE ANY APOLOGIES he simply does not care. All he can think of is what is still pending as payment (according to him that is.) We  already paid them over $100,000K and have nothing to show for it!!! At present time, i spent the whole year 2011 trying to recoup such depressing experience and raise the necessary funds to finish the site. I had a new interested investor a some point and necessarily needed the website to be somehow visible for them investors to view it as is, but Gary wanted more money and didnt care that he took all I had raised + more than was contracted. We needed the site visible to raise money and then pay moonrise to deliver the site to a new development team I had in Canada, this way I could get ride of Moonrise altogether and move forward. I ended up loosing the new potential investors because of Garys childish behavior and that is when I blew a fuse and told him and his wife that unless they showed serious and positive professional behavior to help and deliver this  project along side with me I would have to tell the world by writing complaints on all scam board across the WWW, they refused. I then sent them a last email warning telling them I wanted all the money back else I would hire a team in the Philippines to blast the www with Moonrises dishonest behavior towards their customers. They refused. I then went myself online for half an hour and did just that, write 4 or 5 complaints on some scam-alert websites including this one but under aliases to avoid having my name all over the web, I didnt even keep record of the login and user-name I had used on these sites and it took me hours to find some of them including this one. But nonetheless, I realize now is not right since I have nothing to hide in this matter, so I should come forward with the truth including my real name and company. I did all I could to keep them motivated and professional and they simply abused of us in a very dishonest and abusive way. I also looked for juridical assistance with a law firm based in SF and have been trying to make them change their dishonest way for over 18 months but of no avail. See, just a month ago was my last attempt to make them come clean and deliver whatever is available on the website + pay the necessary expenses to launch our "Gift a website" project for this Christmas 2012, and for the 3rd time, the 3rd Christmas possible launch since I contracted them back in 2010, they still refused and completely rejected my simple request, proving by such behavior how unwilling they have been all along to be professional, honest and to deliver the product they have been well paid for. I am now awaiting on a jury as well as the verdict of a judge in CA to deliver me from this abusive company and people.
