Problem With My Rest Co., Tampa, Florida, at Myrest.com

The Short Story

We needed new satin waterbed sheets. I have purchased sheets online in the past but could not recall the vendor. A few quick searches on Google brought up MyRest.com. Their home page offered Free Shipping so I looked at their offerings and found: (Large type, my text, Small type, copied from their web site)

I looked for a return policy in the Account Services area of the Homepage but saw no restrictions, just the procedure to return an item.

I placed an order on May 27th and paid with my credit card. The sheets arrived on June 8th. Upon opening the package, it was immediately apparent that these were not the sheets I had ordered. They were NOT very smooth, slick and silky but had the texture of cheap cotton.

I went back the MyRest.com and completed the Return Merchandise Form which came with my sheets already listed. I followed all instructions carefully, listing the RMA code on the outside of the package, and mailed the package on June 9th . I also used Delivery Confirmation on the package. USPS delivered the package to My Rest on June 15th.

By June 30th, I did not have a credit on my credit card so I used the Contact Us on their site and ask why no credit. I received an automated response on June 2nd and an explanation on June 3rd stating : Your sheets have been refused by our warehouse. The sheets will be sent back to you. They are a nonreturnable item..

I called My Rest's 800 number, spoke to Sarah and was passed on to Todd. After being disconnected and redialing, I explained the problem. Todd informed me that, by Florida State Law, sheets were nonreturnable. I explained that the sheets I had received were NOT what were described on the web site and not what I had ordered. His response was basically, tough shit! They would not take the sheets back and I wasn't going to get my money back.

In essence, I did NOT receive the merchandise I ordered. My Rest either shipped the wrong sheets or committed fraud in their description of the sheets. Since they claim that Florida law prohibits the return of sheets, they committed a fraudulent transaction from the start. They shipped a low grade of merchandise knowing in advance that the customer had no recourse. My Rest stole $69.95 for sheets they did not deliver and cost me an additional $7.26 in postage, and to date have not returned the sheets to me as stated in their email.

I would strongly recommend that anyone considering making a purchase from My Rest, reconsider and chose another vendor!




All the gruesome details

We were in need of new satin sheets for our waterbed. I have purchased sheets online from a couple of online vendors in the past, however, I could not recall who they were. On May 27, 2006, I Googled satin waterbed sheets and one of the companies that came up was My Rest at Myrest.com. The first thing I noted was that they offered free shipping so I looked through their offerings. I found the following:

These sheets looked to be exactly what I was looking for. The price was comparable to what I had paid in the past and shipping was free. I looked at several other areas on the home page including the Account services area shown below. I checked the Return a Product and could find no restrictions.

In none of these links was there any statement that there were any restrictions on returning sheets nor was there a link to any other area of the site where restrictions were stated. Therefore, I placed an order for the sheets and paid with my credit card.

The sheets arrived on June 8, 2006. I carefully opened the package and inspected the sheets. They were NOT as stated! They were NOT Made from the highest quality satin available, these sheets are very smooth, slick and silky. They felt like cheap cotton sheets. As noted, we have purchased and used satin sheets for a number of years, at least 10, so we know what they are supposed to feel like. The sheets were unacceptable!

I went online to MyRest.com and followed the links under Account Services to Return a Product and followed the instructions. I completed the form. The form automatically entered the item I had purchased and the price, $69.95, noted a Re-Stocking fee of $10.49, and told me to await an email with return instructions. A few minutes later, an email arrived with return instructions. I followed the instructions, noting the reference number on the shipping label as instructed. I sent the package via USPS First Class Mail with delivery confirmation on June 09, 2006, at a total cost of $7.26. USPS shows delivering the package to 12627 Race Track Road, Tampa, FL 33626 at 11:16 AM on June 15, 2006.

As of June 30, 2006, no credit had appeared on my credit card, therefore, I went to Myrest.com, clicked Check your return status and found nothing on the return. I clicked on Contact Us completed the form, asking why the credit of $59.46 had not been applied to my account. On July 2, 2006, I received an automated response:

Your sheets have been refused by our warehouse. The sheets will be sent back to you. They are a nonreturnable item.

As of July 3rd, the package has NOT been returned to me.

At about 10:30 AM PDT, July 3, 2006, I called My Rest at 1-800-469-7378. After working through the options I spoke with Sarah and explained the problem. She said she would ask a supervisor and then said she would transfer me to Todd. I was disconnected during the transfer. I called again, spoke again to Sarah and she again transferred me to Todd. Again, I explained the problem. He stated that sheets were non-returnable by Florida State law. I ask why this was not stated on any of the links under Account Services, on the order form or product description. I told him that I had looked at all of these and found no mention of this no return policy. He stated that it could be found under Help on the Home Page. I stated that since this policy was not made clear in any other area of the site, the site had generated a Return Merchandise Form which told me to send the article to the Tampa address, I had paid the postage as required as well as agreeing to a restocking charge, I would NOT accept this decision. I would contest the charge on my credit card as the merchandise was NOT as stated in the relevant web page as being Poly-Satin King Sheet Set Champagne, made from the highest quality satin available, these sheets are very smooth, slick and silky. Our satin sheets are tightly woven, luxurious, and durable. Todd said fine, but that they would not take the sheets back.
