NCC Investigations Harry Miller Fraudulent Collection Scam Marietta, Georgia

On January 28, 2013, I received a voicemail from Harry Miller, purporting to be some type of enforcement agency.  In the recording, he indicated that I had a pending case for fraud and theft, and I should get back to him within 24 hours.  He left a similar message on my VM on Jan. 29, 2013.  

Upon investigating the company, NCC Investigative Services, I learned that they had a history of intimidation and harassment in dealing with consumers.  It turns out that they are bottom feeders, buying defaulted debt from payday loan companies.  Therefore, I researched Indiana Code regarding the regulation of such companies, and learned that it is illegal to file a criminal charge or intimate that a charge will be filed in the event of a default. Therefore, what they are doing is both illegal and a scam.

Statutes regarding payment loan companies vary by state; however, according to IC 24-4.5-7-101, these companies can both be prosecuted and sued for damages for violation of these statutes.  The consumer can get up to $2,000 per occurrence, plus costs and attorney fees.  This company should either be shut down, or penalized and put on the straight and narrow.
