NCO financial is trying to collect $4802 for JC Penneys. In 2005, we filed bankrupcy and JCP was notified but did not respond. Now they are trying to collect thru this NCO even though I have sent them case#'s and attorney name but they consistantly badger us. They are even sending mail to my former employer. My correct address is 3xxx Rxxxdr, #x, Rainbow city, al 35906.Thank you for any thing that you can tell me to stop this harrassment.

Office of Thrift Supervision

AUTHOR: Nina - (U.S.A.)

This is the office that supposedly oversaw AIG and gave the green light for them to go ahead with the actions that led to the downfall of the US economy. Yeah. These are the guys to call...they might get something done.

Watch out for NCO

AUTHOR: Jeanski - (U.S.A.)

NCO is a very disreputable company that buys old debt and sometimes just makes it up! They did this to me with a Sprint bill. Despite the fact that I still had the receipt showing the bill was paid on time, AND a letter from Sprint Corporate saying the same thing, this company hounded me mercilessly. I finally hired an attorney and won. It didn't cost me anything since his fees were paid by NCO. Just watch out for them, OK?

This will almost always work:

Step One:

Send them a letter via Certified Mail + Return Receipt stating:

Per the Fair Debt Collection Practices Act, I am requesting that you cease all communications with me about this debt which was discharged through bankruptcy and that is no longer collectible. This letter is being time stamped via Certified Mail and I can confirm receipt. I will pursue each subsequent phone call from your office with a $1,000 per incident penalty for Fair Debt Collection Practices Act violations

Step Two:

Next time they call, read the following statement:

Pursuant to [your state] state law, this is to inform you that this phone call is being recorded. If you do not consent to being recorded, you need to terminate this call. Pursuant to [your state] state law, continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.

File complaints with Federal Trade Commission and Office of Thrift Supervision

AUTHOR: Laurie - (U.S.A.)

JCPENNEY/GEMB screwed up my account and then sold it to a collection agency without ever NOTIFYING me that there was a problem or made any attempt to fix the problems they themselves created!

JCP/GEMB will not work with you in regards to thier ERRORS unless the complaints come in via the Office of Thrift Supervision.
