 I am writing this letter because I need to bring a matter to your attention with regards to New Vista Properties/Homes. This company is taking advantage of individuals during the housing market problems. This issue concerns land, home buying and property building with percentages on mortgages for payments of these homes in Florida reason: we are not presently living there but would like to retire there.

 I am living in New York; I am 59 years of age and getting ready to retire. I have saved some money to buy a retirement home in Florida.  In 2006 a Real Estate Brokers satellite office of New Vista) from N.Y. took some people including myself down to Florida to purchase parcels of land that was selling. I bought a piece of land and have been paying on the land from 2006 – 2007 (over a year).  No one informed us that we must finish paying for the land before we could build. In October 2007, I contacted the same company who sold me the this piece of land (New Vista Properties – Mr. Robert Ehrling & Lien Alvarez (Assistant) - 15500 New Barn Road, Suite # 100 Miami Lakes, FL 33014 then – they are now at 8000 Governors Square Blvd., Suite 200, Miami Lakes, Fl. 33016- 305-818-1919) I made the necessary arrangements to start building my home. I went down to Florida with money for my home deposit to start building before the prices of the houses become extremely exorbitant, during that time the prices for building a home in Florida was not high, during the building of the home the housing market collapsed and a year later the house was completed.

 In 2008 (a year later) I got a call that my home was completed and I should consider coming down to Florida to close. My house was $258,000.00 based on the deposit I put down. That was when I found out that the land price was wrapped up with the building cost for the house. I was not told that I would not be able to build unless the land was paid off; however, they wrapped up the land with the house price. I didn’t realize that within the year of building this home the prices of house of what the house cost declined tremendously but due to the fact a contract was signed I got caught.  After trying to get a mortgage for the amount that I signed a contract for a year earlier, no bank would approve me for a mortgage, the banks then informed me that they could not approve a mortgage to me for more than the amount the house is valued/appraised for because the prices for my home was worth more than the market value.  I then realized that the price for my home have decreased excessively to less than $200,000.00. Every bank I turned to would not assist me even the bank that New Vista send me to would not give me financing but there was a reason for this Robert Ehrling wanted to do the financing himself. I tried different mortgage companies even Lending Tree but none would assist. The assessed value on the home was $190,000.00, at that time, by now it is worth much less.  I was prepared to walk away, but I had invested about $45,000.00 or more in land and the house deposit.  This was my retirement money that I have saved and invested. I tried to work with the New Vista Properties in every way he would never reconsidered his price. I then contacted a lawyer in Florida who called him. I then contacted a Lawyer they wanted me to pay $5,000.00 as a 1st installment to handle my case; I did not have that kind of money. One of the lawyers called New Vista  Properties then finally, I got a call from New Vista Properties/Homes Mr. Ehrling’s Assistant Office Manager - Lien Alvarez called to say Mr Ehrling, will only take $20,000.00 off the purchase price and he will not go a $ lower. I then consider, $20,000.00 off $258,000.00 leaves $238,000.00, the home still valued much less than that amount, I then asked which bank will help me to get a Mortgage for a house that cost way more than its value (up-side-down) she said New Vista will give us the mortgage @ 7½% for 5 years and after that 5 years they will need a balloon payment. I was so depressed and stressed out after months of struggling with them to lower the house prices and finding a Bank. I accepted the offer, I went down to Florida in January 2009 sign and close on my home considering and hoping that I should be able to refinance before the 5 years and get my home from under New Vista. But then, I am saying, what if the housing market doesn’t pick up within the 5 years I am doomed. Which it hasn’t picked up and here I am still struggling with Robert Ehrling.

 It has been extremely hard paying the mortgage, when banks are reducing their mortgages at a very low low % rate. New Vista Properties would not consider any reduction for me; it got to the point now I must write to you to let you know what this company is doing to people. There is no overtime on my job, they are cutting hours, my bills are increasing, and I am struggling to pay a mortgage in NY.

 I contacted a Mortgage company to see if they would refinance and take my mortgage from New Vista, just to get lower mortgage rate, the manager at the mortgage company told me to ask New Vista if they would take $138,000.00 and close the deal I called Robert Heeling and he totally refused to speak to me. The other banks are letting me know that it will be very difficult because it is a private mortgage. I NEED HELP, IF I DO NOT GET HELP I AM GOING TO GET SICK. I am diabetic and I have high blood pressure and I think about this every day.    

When one look at these payments @ 7½% at the end of 5 years I will pay New Vista Homes three times what I owe for that house, after five years all I am paying is interest.  The owner of New Vista Properties (Robert Ehrling) is very tough, inconsiderate and rude to minorities, he was very nice when I was buying his land and building my house but since the market declined, I cannot speak to him regarding the house price issues he refused to speak with me, he only speak to us through his Assistant, then she tells us what he can and would do in the form of threats, saying “Mr. Ehrling – that he can take back my home from me because you sign documents”.  Not because I sign documents (Promissory Note) before the housing market collapse means I must pay that price for the house even though the assessed value on the house is much lower. Right now I am very depressed, because no one is willing to listening to me, I cannot get any help and New Vista refuses to cooperate with me.  

In September, 2011 I ask for a lower percentage rate for my Mortgage because all my overtime was cut and I had more debt and bills increases. He then reduces the interest rate to 6½ % that I have been paying but recently I lost my tenant and I sent an e-mail to Maria his assistant (See attached with response from Mr. Ehrling along with a copy of the Promissory Note as my reminder.) When am I ever going to pay off this loan? I have already paid him over $100,000. (See attached list) I am sure this Promissory Note is not even recorded in Florida (see attached).

 If I do not find a Mortgagor who will take this Loan from New Vista by 2016 as noted in the Promissory Note, I will have to make a balloon payment in 2016. Where am I going to get that money from, so therefore Robert Ehrling will take my house and all my money I have invested for my retirement? I have already make payment totaling over $100,000 and my house is still under water, it is now worth maybe $140,000.00 the most.

 A friend of mine who bought his house the same as mine walked away leaving Robert Ehrlich with a house and no money back. I do not wish to lose my home I have invested too much money in it and he refused to reduce the price with all the low interest rate the government is offering I cannot get anyone to take the Mortgage from him because it is a private loan mortgage. I am at a lost. The land was included. The land price was about $45,000.00. My son just bought another piece of land from Citrus County BOCC for $3,000.00 adjoining my property (the same property) I was robbed by New Vista and I went on to build my retirement home with him. My Mortgage now is $1,838.00 per month. I need to know what to do right now. I have had it. I tried to get a Mortgage Bank to take it but no bank will. Do I have to pay off $238,000.00 to New Vista before I get a bank to take this mortgage at a lower %. I did not know that New Vista Properties/Homes is the same General Development that bilked previous customers’ years ago. (See attachment articles). A friend sends me these articles because I do not live in Florida. I almost had to pay the IRS for moneys that New Vista did not report the interest they were collecting monthly from my mortgage. I had to send them my letter from New Vista with all interest paid.

PLEASE, PLEASE HELP!!!!!!!! He bought these lands for nothing and sold it for thousands of $. I am asking that someone from your office or any office that is in authority to please contact to Robert Ehling and let him reduce the price on my house by the value of the land price or modify the amount of this house.

 Please see what your office or someone in any of your banking facilities can do for me. I am burden with debt. Not because we sign a contract before the housing market declined, and still is declining, he can work with us. He is a hard ball and we do not know what the future holds.

 If we could get a reduction in the price of the land that is wrapped up in the Mortgage it would reduce the amount significantly, or reduction of the % rate to reduce the monthly payments of the mortgage making it more manageable to pay the mortgage on the house making it conducive to the prices of the houses in the neighborhood that will be a tremendous help.

Documentations I received from New Vista Properties on these mortgages can be provided. Your attention in this matter is seriously needed.  Please help me find a Financial Institution that will take over my mortgage for me, I would truly appreciate it. I am looking forward to hearing from you. I feel as if with no help I will commit suicide. I cannot buy that house twice.
