My car was repossed in July of 04 and I take full responsibility for that. It was irresponsible on my part. I however, paid all charges and was able to redeem my vehicle prior to the sale of it. I ended up paying an additional $500+ over and above what was indicated on the certified letter they sent me. Payment was sent to them by Western Union quick collect. I was never informedc what the additional money was for. I assumed they werre making me pay the next months payment since it was due in the next 2 wks.

I redeemed my car in late Aug and figured they were making me make Septembers payment before reinstating the contract. I did not complain and was happy to get the car back. I never received the monthly statement until October which I didn't question thinking all was current. I never even opened the statement. I got a call from Sokhom Sim @ ext 4772. This is who I dealt with to get the car back previously. So I calledcd him right back and told him I would be sending out the total amt due + Novembers pymt (2 wks early) that same day. I explained the misunderstanding and ensured him pymt was going out that same day.which it did.

This took place on a Friday afternoon. Sunday, the repo man took my car. I pleaded with him to contact Nissan beofer taking it because I cleared it all up, so I thought. Monday AM I called Sokhom back to tell him what happened and he said he knew and Nissan no longer wants to do business with me and I have to pay the contract off in full to get it back. I asked him why ne never said anything about this on Friday and acted like everything was OK. I told him the pymt was probably already in their office. Said he didn't care and that I should have WU the pymt.

I went on line and made another pymt for the same amt I mailed in. And the payment was accepted and applied to my acct. also the check was cashed. so now they in reality paid thru Feb 2005. I contacted his supervisor HEATHER who was worse than Sokhom was. There was no talking to them about any of it. now they are going to sale the vehichle for alot less then I owe on it and charge me for the balance. Where is the voice of reason? I even suggested putting them on automatic pymts so no more late pymts. They did not care.

I don't know where to find out my rights for this specific info. It doesn't make sence. everyone loses. it will cost them to try to recover money for the balance.I don;t know where to turn and am running out of time. I can't really afford an attorney and just would like to find out the law and procedures they have to follow. especially re: notices of where my car is etc and accepting pymts after the repo. I have never been treated so badly by any creditor in my life. This is a nightmare.
