This is a true story of UNCONSCIONABLE GREED that originated 8yrs ago (2006).

I was rear ended by a Buick sedan in my MINI COOPER, amazingly I escaped injury, but my little car of course did (from the 45mph impact) anyway to get to my point of sharing this ordeal...I allowed & TRUSTED Penske Automotive to repair my car.

That was an extremely bad mistake that not only had me being charged $800, only 2 weeks after my car was returned to me, cosmetically repaired, BUT, far from road safe: On my way to work, as I was about to enter the freeway, the "left rear axel arm" breaks for NO apparent reason...other than the recent rear end collision the car had been in.  

After consulting with other reputable Auto body shops, they agreed that the car no doubt sustained damage to the axel that was obviously not identified by the shop (Penske).  They of course denied it. At the advice of legal counsel,  I immediately STOPPED PAYMENT on the check. Never hearing from them again until recently 8yrs later; after ALL supporting documentation & records have long been destroyed...they strategically waited to reinstate a lasped civil court judgement, again trying to greedily collect on a problem that was clearly their fault,  and Thank GOD could have gotten me killed on the road.

WARNING!!! Do NOT TRUST this place to repair your car.

- How the heck did this judgement come in?  Did you go to court at some point and the judge decided against you?

Because just based on what you wrote it sounds as if you may not have had justification to stop payment on the work they did.  The reason is that they were not paid to fix the rear axle, so as long as they repaired/fixed what was on the estimate they are most likely entitled to that money.  However, you probably had grounds to sue them for additional damages if you want to claim that it was their neglect that they didn't notice the damaged axle.

Oh and yes I know this is what an attorney told you, but it may have been a good idea to get a second opinion.

Anyways, after 8 years it is probably too late to go after them, and unless you didn't know about the civil suit where you could try and get it vacated, you probaly owe it.
