I had done the assessment in a timely manner, and turned it in, and they confirmed that I was in compliance, but upon further review on my October Statement (before the compliance was an issue), NPC and Thomas A. Wimsett had charged the $119.75 service fee.

When I called them and asked them what it was for, one of the things she told me was that it was for the SecurityMetrics fees.  I said "so like, you've charged us the fee, so when we contact them, they don't charge us anything?" and he said YES.  There was never going to be a charge from SecurityMetrics unless you were NON COMPLIANT.    Also I was told by Thomas A. Wimsett that the $119.75 fee covers "compliance related services, association relationship maintenance and product integration and management"  I asked what that meant, and he got all condescending and rude towards me.  he basically said it's a new annual fee, which they MENTIONED on the September statement "Effective October 1, 2008, the following fees will be added to your account or increased. Continuing your merchant account with us or use of your merchant account on or after October 1, 2008 will represent your acceptance to these terms.   Your Annual Compliance Service Fee will be increased to $119.75 and will appear on your September 2008 month end statement. 
This fee will be debited from your designated settlement/ direct deposit account on or after October 1 and this fee will be billed
annually thereafter.  This does not affect your compliance responsibilities associated with your account." but never explained, even one bit.   I asked why it was not explained, and he tried to insist that it was.  When I read her the statement, she said "that is all we have to explain to our clients.  When you don't understand that, you can call the 800 number and you can speak to someone like me who will explain it." 

Beware people.  This fee is BS, but you can't get rid of it no matter what you do, even if you cancel your merchant account they won't refund it.  No way. No how.  And if you dispute it with your bank, they will lie to the bank and tell them that you agreed to whatever charges they want to impose, and the bank will have no choice but to side with them.  It really is a rip-off.  Stay away from NPC and Thomas A. Wimsett if you can!!!

PCI Compliance argument is a scam

I'm amused at the 'consumer' review offered in defense PCI compliance fees levied without authorization by NPC. First it implies that the company NPC is somehow out of compliance due to nondescript factors, and that the only solution is immediate excision of the customer's money.

In my case that seems to be the only thing that was done-no further communication about compliance was proposed or implemented. Further, no reputable processor could expect to levy a gargantuan charge - $229 in my case - with little warning and no recourse.

To add insult to injury, NPC repeatedly refused to process a change of target bank account correctly submitted per their own instructions, and then insisted on withdrawing funds from the closed account. 

My new processor assures me they will  never attempt to levy a compliance fee because they've been 'compliant' all along. NPC breached its contract with us in a major way, and they need to be held accountable for trying to bully its customers into unauthorized and unwarranted overcharges.

PCI COMPLIANCE FEE EXPLANATION

The PCI SECURITY ASSESSMENT is to protect merchants and their customers from fraud.  NPC and all other credit card processors are now REQUIRED by law, and Visa/Mastercard International to complete a security/technology assessement of every merchant that processes credit cards.  Yes there is a fee to do this assessment.  The software, technical support personnel and the maintenance required to make sure everyone is compliant with the new laws and rules is quite substantial. 


Come on people, pay your fair share and quit complaining about things that are designed to keep our data secure.
