I had done the assessment in a timely manner, and turned it in, and they confirmed that I was in compliance, but upon further review on my October Statement (before the compliance was an issue), NPC and Thomas A. Wimsett had charged the $119.75 service fee.
When I called them and asked them what it was for, one of the things she told me was that it was for the SecurityMetrics fees. I said "so like, you've charged us the fee, so when we contact them, they don't charge us anything?" and he said YES. There was never going to be a charge from SecurityMetrics unless you were NON COMPLIANT. Also I was told by Thomas A. Wimsett that the $119.75 fee covers "compliance related services, association relationship maintenance and product integration and management" I asked what that meant, and he got all condescending and rude towards me. he basically said it's a new annual fee, which they MENTIONED on the September statement "Effective October 1, 2008, the following fees will be added to your account or increased. Continuing your merchant account with us or use of your merchant account on or after October 1, 2008 will represent your acceptance to these terms. Your Annual Compliance Service Fee will be increased to $119.75 and will appear on your September 2008 month end statement.
This fee will be debited from your designated settlement/ direct deposit account on or after October 1 and this fee will be billed
annually thereafter. This does not affect your compliance responsibilities associated with your account." but never explained, even one bit. I asked why it was not explained, and he tried to insist that it was. When I read her the statement, she said "that is all we have to explain to our clients. When you don't understand that, you can call the 800 number and you can speak to someone like me who will explain it."
Beware people. This fee is BS, but you can't get rid of it no matter what you do, even if you cancel your merchant account they won't refund it. No way. No how. And if you dispute it with your bank, they will lie to the bank and tell them that you agreed to whatever charges they want to impose, and the bank will have no choice but to side with them. It really is a rip-off. Stay away from NPC and Thomas A. Wimsett if you can!!!
