I had a loan modification with Nationstar which was out of our financial means. They kept adding additional fees which made it impossible for us to meet our obligation. Feeling we had no choice we filed a chapter 13 Bankruptcy and the original pymt plus escrow for taxes and insurance was agreed upon. We are in a 5 yr plan of which we have been paying for 3 1/2 yrs. In July of this year we were notified that our pymt would increase over $300 a month due to the interest rate being raised to 10.99%. I immediately contacted our attorney and was told that Nationstar had not filed with the court for an increase in payment and until they do the payment would remain the same. Recently we had some storm damage to our home which resulted in needing a new C/H unit . We filed the claim and the ins agency sent a check to NationStar for the repairs to be endorsed by them and us. I contacted NationStar and was told we are deliquinent and that there were several steps we had to follow to get any money released because of our account status. NationStar never filed the appropriate paperwork for an increase in payment with the courts. It is winter in Tennessee and our heat is not functioning correctly . We have a 4 yr old . I explained the situation to an account specialist and was told they can not do anything until 2 packets of paper work have been submitted and then they'll only release 1/3rd of the money to our contractor . This could take weeks and in the meantime we are being subjected to a cold home for ourselves and our 4 yr. old.
NationStar's own negligance by not following proper procedure is not our fault.
Is there anyone aware of a class action suit against them ? If not I think we should get one started. I believe what they are doing is wrong and that we the consumers are the victim of an unscrupulous lender . I also believe the ridiculously high interest rate is "price gouging" and we are victims of their own corporate greed. Is there a Class Action Suit open ?
