Actually my complaint is more of a question kinda. My husband had an account in which went negative the bank then turned around and took down to the last penny we had in our joint account and applied it to the negative account in which my name is not even on .....can they really take money out of my account to apply it to an account my name is not even on. I have two kids and can not even afford diapers now. My name was not on the account that went negative, how can they take my money for this.

Sad but true

They are absolutely within their rights to do this. It is legally called Right of Setoff. Even though you weren't the one who overdrew the joint account, his name is on the joint account and they can tap that account for the debt.

I hope he does the right thing by you.

as long as his name is on the account they can take the money from it.although they usally give the person resonable time to get the other account out of the negative.i learned the hard way years ago with a lived in girl friend.we had a joint account for the bills.then of course our personal accounts.well lets just say she had bounced checks every where.so to make it up they took it from our joint account which was my money for the bills.oo by the way she had yet to put her money in it for the bills.maybe she knew something i didn't at the time.leo ohio
