I have my account closed by NFCU when learned I filed a bankcruptcy against them. My account is where my paycheck goes twice in a month and I need that account to pay my bill, buy food for my wife and two daughters, withdraw cash from ATM's and to pay some other expenses. Now that my account is closed I don't know what to do to all of these personal business. Please help me get my account activated.

TRUE NFCU Closes Accounts w/BK

To the NFCU employee that commented you are incorrect and misinformed. This report is accurate and true. We have had similar experience, NFCU closed and froze our access to all accounts just recently. NFCU tried to collect second mortgage illegally from our account while we had a court ordered stay on our debt until our hearing. I called them out on it and informed the BK mortgage department and slam dunk they closed our accounts. We are currently going through a BK after hubby suffered a massive stroke and is 100% disabled and lost his DOD job so no way to pay mortgage or continue our lifestyle. We have had to cut back and basically starting over, losing everything and can simply not pay our debt through no fault of our own. We were and are being treated like criminals by a credit union that we have been members of since the 1980's.   We were smarter than most and did our homework.  I moved all of our direct deposits and opened accounts with another credit union but still had some outstanding automatic debits that needed to be paid. It was an ordeal just to have a $24 debt paid through our account. I say BE WARNED as NFCU is heartless and uses illegal collection practices. NFCU informed me that they only services the equity lines and second mortgages therefore their excuse that they didn't know ?   Good riddance NFCU and i hope that others take notice BEWARE OF NFCU BAD BAD BAD business practices, sadly not how they used to be....

I am a bankruptcy attorney in California. While I am aware that NFCU does abuse clients that file for bankruptcy and that have debt problems, it is unlikely that your account is closed. Some financial institutions will sometimes freeze the account of someone who filed for bankruptcy until they get clearance from the bankruptcy trustee.

It is usually a good idea to move your bank accounts before filing bankruptcy and have a low balance in the accounts before you file for bankruptcy. Some banks will seize money to pay other debts you owe them such as a car loan or a credit card.

Contact the supervisor of your local branch to see about getting your account privileges reinstated. I would also suggest retaining a bankruptcy attorney who is a member of the National Association of Consumer Bankruptcy Attorneys for further assistance.

I work at a branch office as an employee of Navy Federal and we do not close accounts just because someone filed for bankruptcy. We do restrict your access with all electronic services being prohibited and that alert will remain on your account for many years. When (and if) you go to a branch office, in order for us to do something on your account, we will have to have a supervisor's approval. I suggest going to your local office, and if there is not one, calling and speaking to a representative at 1-888-842-6328.

I dont think this is entirely true. They likely didnt "close" your account they probably "restricted" some of your abilities. Under bankruptcy law, which I am not 100% versed on of course, notification is required to all institutions you do business with or you are claiming protection from. If you are represented by counsel, which I presume you are, I would discuss this matter with them and identify a course of action. I would also stop by your local branch of NFCU for more information.
