I am a Marine Corps veteran and had been shopping for a new (used) truck for some time. Came across North Texas Truck Stop on Ebay. Even though I was nervous about buying from an out of state used truck dealer, I went ahead and contacted them. They had a truck I was interested in so I called and talked to Tim (a salesman there). The very first thing I asked was if the truck had a boost controller or any other chip, etc or if there was any sign of one being installed in the truck. He assured me there was no chip, controller, or sign that there ever was a controller installed. I stated that I absolutely wasnt interested in buying the truck if it had those modifications, again he said no sign of it.

My second question was the amount of lift on the truck, to which he stated "6 inch lift".

Well, after being pressured into placing a $500 deposit and buying my plane ticket, I find out the truck indeed had a controller mount and was lifted 8 inches, rather than the 6 inch he told me via the phone. I was unable to contact my salesman for 2 days via text, phone call, or email. When I finally was able to contact Tim, I told him I wanted my deposit back as the truck was misrepresented. He said he would talk to his boss. A short time later he contacted me and said "we are keeping your deposit", I then offered to take 50% refund of my deposit as I was trying to be fair with them as they had to relist, etc. Again, he came back with "we are keeping your deposit".

To sum it up, North Texas Truck Stop is shady and have no respect for Veterans. My advice is stay away from North Texas Truck Stop. They will misrepresent vehicles and will slime their way out of refunding deposits.

  Mr Dealer,you said,it is a 6inch lift on top of a stock 2 inch and that he was not even there so you don't know how he would know it was an 8inch lift to beging with.Obviouly he does know because you just confirmed it,so why would you call an 8inch lift a 6 inch lift?Also you mention keeping the deposit because you have to take the truck off the line.Well most people drive by car and truck lots on a daily basis and not see anyone there looking around at the vehicles.But you have them lined up to buy so I can see where your coming from with that.  

  I do believe he is also at fault because I have called about plenty of vehicles and they have asked for a deposit and I told them go ahead and sell if you can,if you can't I will look at it when I get there,and they are always there,so that should be a little lesson there.

  Like I said,if 500 bucks is going to make you or break you your probably in trouble anyway.But to keep 500bucks that a person gets nothing for there money,well what would you call that?Unhappy people don't make good customers,but you still have your contract that makes you right.

So we owe him a moral debt because he defaulted on his obligation? I don't quite follow you on that one. Deposits exist for a reason, just like earnest money on a home. A deposit means you are obligating yourself to complete to an agreed transaction. If deposits are refundable, then that defeats the whole purpose of a deposit.

This is not about $500. This is about a person committing to buy then backing out of the deal. We move 150 trucks a month and don't have time to be pulling inventory offline and losing potential customers while someone commits to buy, then changes their mind. It is simple business.

If he had ever come to our lot and actually inspected the truck and found that it was misrepresented in any way or if it failed an independent inspection, then we would have gladly given back his deposit and do so on a regular basis. It is about honest and integrity, neither of which has this customer shown to us.

   All I want to know,is it worth all this to keep 500 bucks.I don't know any people that actually like vehicle sales people and as far as I'm concerned this just adds to it. If 500 bucks is going to make or break you,you are in trouble anyway.You may have legal right to this money but not a moral right.Had you given back his money he may have sent some business your way or even considered buying from you later on,now look where you are over 500 bucks.What is it worth to think your right,or does keeping the money make you right.

There are two sides to every story and you, sir,  know what really happened here. It has nothing to to with your status as a veteran or "ripping off" anyone. It is shameful that you would pull the "veteran card" and accuse us of targeting our soldiers and/or veterans for dishonest business practices instead of taking personal responsibility for not honoring a deal that you negotiated, agreed to and placed deposit on.

Deposits exist for a reason. A deposit is "good faith" or "earnest" money that you will honor the terms of the negotiation to which you have agreed. The deposit protects us, as a business, from the losses that we incur by pulling a vehicle off the market, losing prospective buyers and all advertising fees associated with placing a vehicle back on the market in the event that a customer changes his/her mind. The deposit is also there as an incentive for the customer to make sure they are committed to honor their word to do business by the guidelines of the negotiation to which they have agreed. If a customer is not 100% sure they are willing to do business, the customer should not place a deposit.

We do not pressure anyone to place a deposit. In fact, the pressure you refer to in this situation took place via text message in which you asked, "will you take $XXX", to which Tim replied, "no, but we will take $XXX". To this, you said "ok, let's do it".

Now, let's keep in mind that you have never seen this truck in person...

The misrepresentation that you refer to in the form of a "controller mount" is, in fact, a cell phone mount and not uncommon in any vehicle. The fact that this is a cell phone mount is further backed up by the installation of an aftermarket Motorola bluetooth system that interacts with the mounted cell phone. However, here you are arguing this point as the crux of your decision to terminate the deal. Furthermore, the mount in question is clearly pictured in the advertisement. If you had any reservations about this being anything other than a cell phone mount, the time to inquire would have been before you made your $500 deposit. It is obvious that we disagreed on this point. Being that we have possession of the truck and can inspect it more thoroughly than you can, in addition to the fact that the mount is obviously a cell phone mount, we contend that we are not misrepresenting the truck.

The truck does have a 6" lift on it. It has 6" rear spacer blocks on top of the stock spacer blocks. Therefore, it is lifted 6" over stock. I am not sure how you later found out that it has an 8" lift, since you have never seen the truck in person and we are here to measure it.

The fact of the matter is held in this email from you to Tim, quoted in its entirety, in which you explained your real reason for not honoring your commitment to purchase the truck:

"I have been unable to reach you (however, I do understand it is your day
off). I had sent you text messages on Friday asking about the warranty
offerings and was told today that no warranty is available for purchase
on this truck.

I had also read numerous negative feedback on the internet about North Texas Truck Stop.

The negative feedback, not being able to buy a warranty, and being unable
to reach you all weekend have made me not want to buy this truck.

What are my options at this point?"

Here is the text defining our terms and condition of deposit:

"All sales require a $500 deposit within 24 hours of sale agreement. Deposits
can be made by phone with credit card (Visa, Discover, Master Card),
cash or cashiers check. Deposits are NON-REFUNDABLE unless the vehicle
has been misrepresented or if the vehicle fails a professional, on-site
inspection. Deposits on vehicles not purchased are applied towards the
significant costs of paperwork and title production, advertising costs,
Ebay listing fees and lost dealership productivity."

Finally, why would anyone offer to take 50% of their deposit back "trying to be fair" if they were being "ripped off"?
