Complaint Review: Nuvell Credit Company

Nuvell Credit Company I woke up this morning to find my car was repossed. It is April 6th. My car payment was due on 3/15/10. I am not even 30 days behind and they took my car. These people know that I am on disability Internet

I have a 2008 Hyundai Tuscon which I purchased new.  I have made all the payments.  I got sick this year and was forced to go on temporary disability.  Nuvell knows this because we have been in touch with them several times to explain my situation.  My car payment was due on 3/15/10 which I told them a payment would be made this Friday.  Today it is 4/6/10 and my car has been repossesed.   Now not only do I need to make the payment but I need to pay the towing fees and each day that my car is sitting in the tow yard.  If I was having a little trouble paying the car payment how do they expect me to pay all this money now to get my car back.  They do not care!  It hasn't even been 30 days and now my car is gone.  This company should really be looked into.  I know that the car payments are my obligation.  I have paid off many cars. This is the worst Auto Financial company that I have ever dealt with.

No problem, Janet!  I'm very glad to see you've sought Counsel in this!  The best things which could happen for you is they place some bad information in your credit bureau files because of THEIR mistake!  If so, your attorney could have a field day with them and you turning out to be the winner!  Great work!!!

You are absolutely right that I did not explain myself very clearly when I wrote that first complaint.  I was just so in shock that my car was gone that I just rambled.

This actually all started back in December when I went on short term disability.  We called them and asked if we could have the December payment deferred.  They said yes no problem but to send them $50.00 which we did.  Unknown to us after we sent them the $50.00 check they decided not to defer the payment.  So by the time we were to pay again they said we owed a double payment.  We could not believe they decided not to defer our payment as agreed but had no choice to pay a double payment.  We told them we would send a double payment electronically from our computer (checking account) but they said absolutely not.  They told us they needed the two payments sent by moneygram and we could do that at Walmart.  We couldn't understand why but had to make the payments so they wouldnt take our car.  So that is what we did.  They sent us two statements since then showing that the money orders were applied to my account.  I have the statements in black and white.  They sent me my last statement showing I owed for March 15th.  When we found that they took my car we were scratching our heads because we couldnt figure out why.  Then we called and they told us our money orders were reversed on March 30th (2 months later)  How were we to know this when our statements reflected the money orders?  We assumed from the statements that everything was fine and why wouldn't we?  They are the ones that made us use the moneygram from Walmart and would not accept anything else.  We asked them what a reversed money order meant and they did not know and could not tell us.  They gave us a different number to Nuvell to call and they didn't know either.  They said to get my car back they needed another double payment (mind you this is the second time we paid for the same months) or I couldnt get my car.  I pleaded with them to let me send an electronic payment from my on line checking account.  They said no money order no car!  That original money order did get on someone's desk at Nuvell to have posted it as paid to my account.  Called moneygram and they keep you on hold for hours.  I kept the phone on speaker most of the day as I went about my business in the house and they never answered.  Okay so now we call Nuvell back to say we have no choice and it is against our better judgement but we will send ANOTHER DOUBLE PAYMENT.  They then tell us our car was sent for auction which had only been repossed 2 days earlier and the fee was going to be alot higher.  Okay now we were at their mercy and send the money order in the total amount they wanted us to and they released my car.  We pick it up on Wednesday.  I have contacted a lawyer who is going to take my case because somewhere along the line someone stole my money.  And that is it in the nutshell.  Thank you for responding and I am so sorry if I came off a little too harsh on you.  I was just upset and I guess the timing was bad when I saw your response but I realized after I read my original complaint that it was missing alot of parts.

The bottom line to all this is they repo'ed the car because according to them you didn't make the payments or make good on these "reversed money orders". 

Questions:

Why are you messing around with money orders in the first place?  A checking account is easier to deal with.

Secondly, if what I'm reading is they did not credit these stupid money order payments to your account because they were "reversed".  Did you ask them what that means?  Did you save receipts from these things from Walmart?  Is there a customer service number on the receipt so you can call them and find out what the story is from the perspective of the M/O company?

In your original posting, you said NOTHING about "reversed money orders" or "payments mistakenly made to another account".  You did say you couldn't make the payments.

This response is to Jim in Orlando. First of all I found out that the reason they took my car is that the money orders that they told us to get from Walmart Moneygram were suppossedly reversed (whatever that means).  This didnt reflect the statements we have in black in white stating that they did post the money orders to our account. Now two months later they are saying that they were reversed.  They never told us this.  We don't even know what reversed money order means and they cant tell us either.  Someone in their office apparently got them to post them to our statement.  That is why I was so shocked that our car was taken.  And yes, this is why we can't let this go.  I did not ask them to put pity on me because i went on short term disability.  I know that they dont care about me nor should they. It's just that we kept in touch with them to let them know what was going on.  Called Nuvell yesterday to ask them for the amount needed to get my car out of the towing company and was told that it went for auction.  The point is they took my car for payments that were already paid.  Someone took our money and nobody knows what happened to it.  You really should think before you come down on someone.  I have always paid my bill and you have no right to say that I don't know how to manage my money.  You dont know me at all.  Wow it must be hard for you I mean to be so bitter about life. The cold hard facts of life are they don't care what the reason is you are late.  They've heard it all before, in fact, over and over and over.  The only thing they care about is that YOU agreed to make the payments on time, everytime.  The contract does not give you or anybody else a "pass" for medical reasons.  The reason they did the repo is they think its better for them to at least get the car back than nothing.  If this is a subprime lender, then they will manage their accounts much closer than a prime lender would.

There is nothing different here than the normal account management tactics used by other lenders.  From what you've written, it doesn't appear they violated any laws in this instance.

Bottom line, they felt their security (the car) was in jeopardy.  By getting the car back, they can sell it at auction and get something back and sue you for the rest.
