I applied for a loan modification in October 2009. Hardship was claimed due to the failure of my business. I had never been late on a payment since a re-finance in December of 2006. When I found I could no longer keep up with my payments, I retained Premiere Legal Advocates, (PLA) a loan modification & legal representation company that has been in business since 1992 (AAA Rating from BBB)
I submitted ALL of the information that was requested to PLA who then forwarded that information to Ocwen. Then the Ocwen fast dance and shuffle began. They have "lost" or have claimed to not received my paperwork on no less than 5 occasions. Once they do acknowledge receipt of something, they will then ask for additional information...they don't have any answers as to WHY they didn't ask for said "information" prior.
Then we hear nothing from them for 4-6 weeks. Multiple phone calls are either ignored, or answered by some rep in an India Call Center. Forget about trying to communicate with these people in India!!!
Then we are told that "my case" is being handled by someone named Miguel Bhutia, all calls are forwarded to his voice mail, multiple messages are left, not one single phone call has been returned to the PLA....NOT ONE!!!
After providing ALL of the information that was requested...and ALL of the additional information that was asked for on a piece-meal basis. I get a call on April 2, 2010 from somebody called "Jay" who was calling to advise me the Loan Mod. had been rejected, that they had mailed a letter stating such, and wanted to know if I would consider their "in house" loan modification. I asked why I was declined in the first place. he could not or would not answer me. I asked to speak to Miguel, he did not know who that person was. (surprise...yeah right)
In order to begin the process for the "in-house" Loan Mod I had to (you guessed it) provide some additional information!!!!! I asked Jay rather increduously, exactly WHAT information he thought he might need aside from the volumes of info already submitted??? He said they could not use the information from before, and all the information now had to be on THEIR paperwork/form. I don't know about you reader(s)...but doesn't that sound like BS to you????
Further, Ocwen has flat refused to communicate with my legal representatives, and insists upon calling me personally. PLA tells me this is a very common tactic Ocwen and other banks use. They (the banks) do NOT want to have to deal with attorneys, it is far easier to bluff, threaten and intimidate the average home-owner.
Guess what Ocwen???...I am NOT your average homeowner!!! I am finding a lot of negative reports on Ocwen and their practices. I now have PROOF of no less than two multi-million $ lawsuits where Ocwen has LOST the case. There are literally THOUSANDS more very similar complaints posted on various websites, and I am now making it a mission to not only save my house, but see to it that Ocwen is Banned from doing business in the United States, and / or shut down and severely penalized for their greed, calossness, fraudulent practices, and down right immoral and under handed ways they deal with American Homeowners!!!!!
