First, Ocwen took over my mortgage in 2012 from GMAC. Ocwen sends me repetitious paperwork as often as twice daily. 

Second, Ocwen demands numerous extra fees verbally on the phone yet never in writing.

They told me I owed them fees for "driving by my house" supposedly to check quality every 30 days or more whenever they see fit. I am not in foreclosure. I got behind in January 2014 due to hospitalization and car accident. However, as of May 29 I am caught up on payments. However, I am told on June 1, that I owe more fees for "transfer" - $78. in 2013.  And $153.00 for unspecified "fees."  

I already paid all the fees that  I was told about in April and May 2014 but they keep adding on more over the phone and I can never be caught up..They never tell all the fees even when I ask, only after I have made the

payment then they reveal more fees due.

Third,I receive harrassing phone calls from Ocwen (same phone number) demanding I pay "taxes" or they

will come to my job and arrest me! When I ask Sharif Khan (my Ocwen rep) he says they are not calling me

as my taxes are included in escrow/monthly payment. However, I continue to receive calls from Ocwen and often lately no one speaks, just silent.

Fourth, my loan modification is going nowhere as they demand the same paperwork over and over  for more than a year.

I feel I am being preyed upon as I am 70 years. They continually send me letters regarding bankruptcy and foreclosure, although I am not in either program. I need major help. Ocwen is financially killing me.

Hello Sharon B. and other justifiably violated Ocwen customers,

First let me say that it is unacceptable that Ocwen has treated you in this abusive and unfair manner in addition to being illegal.  I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need.  The debt collectors like Ocwen and Nationstar are simply just scumbags but they can be beat at their own game too just like the big banks can be defeated.  

It pains me that you have fallen victim to the unfair, deceptive and abusive practices of Ocwen (the current biggest offender in the industry) but you do have rights and I would be more than happy to educate you as to how to fight for your rights.  Sharon B. is correct in stating that you need to submit proper QWRs as well as seek outside regulatory assistance from your government to assert your rights, but it can be done and I can attest to it.  No legal assistance is required as you can either do it yourself or hire someone that understands ALL aspects of debt restructuring.  My firm routinely seeks out complaints online so that we can educate as to how to fight back on our weekday show called "The Daily Complaint" where we review a complaint and how to tackle it successfully.  We reviewed your complaint on the show today if you would like to listen, click here.

Our firm presently has many files that we are working on at Ocwen with many more coming in daily complaining of the same servicing and RMA abuses such as yours.  In fact, I have at least a dozen cases in my office right now that we are working on that also have been applying for a loan modification for years with too many abuses and violations to specify here.  My firm requests all the documentation that the servicer (in this case it is Ocwen) produced/received during this period and we utilize those documents as leverage to file complaints against Ocwen for illegal business practices to beat them at their own game, following along the same lines as Sharon B. has stated but with an investigation angle.

I have been paying "fees" with my payment. I also discovered that they have been holding my mortgage payments in "suspense" rather than apply them. I was livid when I finally discovered this procedure, because i was a few cents off on the amount of my payment on one of the payments.

Someone is using the Ocwen phone system to make the spoofing calls to me, I do not answer any calls from them only the one appointment that they make at least 3 weeks in advance. They do, however,continue to call me numerous times per day.

How can this be happening? The dishonesty, harrassment, making up fees to tack on but not in writing.

Aren't there any laws to govern these people? I want out of this horrible financial nightmare.  I have been a real estate entrepreneaur and owned numerous houses pver last 20 years, this is experience is indescribable.

How do you find a powerful lawyer to sue them? Who can help??

Yes I too have been in the same boat but in fact still reamin there espite paying an atty who basically became as frustrated as I have been the past year of living H88L! These people are disgusting! I wanted to record my conversations with them and they refused me..WHY? Because they lie, threaten etc. India is NOT being monitored by the Ofices in Atlanta,GA and FL nor TX. Proof is I met with their Ombudsman and 4 other Managers from USA and they puled up my mortgage on their laptop. Everything I had from OCWEN I brought with me and to say the least They were acting shocked about all the written contridictions in writing. I also included complaints to THE CONSUMER FINANCIAL PROTECTION BUREAU. OCWENS RESPONSE to CFPB was so filed with blatant descrepancies, 2 escrow analysis I never befire reeived for exact same time period with toatlly different figures! One had over $8,000 surplus of my money that the next month went nowhere??? That really set of the American Employees who stated I should have been escalated long before now to the US Division REALLY???? I asked how that was to be accomplished since the only people yo are trapped with are in INDIA!!! PA They are former employees of the now defunct and just as corrupt LITTON LOAN! Basically I have been swindles out of more than $12,000 of not transferred payments made to Litton which by Consumer Protection Guidelines, I nor anyone else cannot not be responsible for other than faxing and refaxing proof of former payments to former company!

Despite all I had been forced into a Modification with dual tracking fees added which is against RESPA/DODD FRANK WALL ST REFORM ACT of  July,2010 whereupon NO LENDER OR LOAN SERVICING COMPANY CAN CHARGE YOU ALL THE BOGUS FEES AND PROCEED WITH FORECLOSURE WHILE SEEKING MODIFICATION! I highly recommend  anyone exploited seek a QWR(QUALIFIED WRITTEN REQUEST) SENT BY REGISTERED MAIL. ACC'dg to DODD FRANK ACT Newly modified once signed for OCWEN OR ANY SERVICING/LENDER ETC MUST comply with time alloted per law...10 days(previously 20) from receipt...30 days to process(previously 60) That is why it is important to send registered return receipt as I always do with my mortgage payment! They are currently almost three months in violation of this law as per their own US Officials! I have all the eviden ce to sue the daylights out of these people and quite frankly judges in NY,NJ,CT have had it with OCWEN!

I have fied complaints with the Federal Banking Commission, SEC,  & I know have a Congressional Senator investigating mine and every cae brought before that office in CT regarding this fraudulent activity this compny choses to engage in! I will say I have owned more than one home in my lifetime and this is the most disgusting experience I have had in the over forty years of home ownership that is besides the former LItton when they were on their way out.

What concerns me most about your report are a couple of red flags:  1) Ocwen calling and telling you that you are going to be arrested unless you pay a fee for taxes and 2) Ocwen calling and no one is speaking - they are just silent on the other end of the phone.

I am not here to defend Ocwen whatsoever because they are one of the worst mortgage servicers in the industry. But not even Ocwen can have you arrested for falling behind in your mortgage payment.

Are these people that are threatening to arrest you asking you to send them funds through the regular bank servicing website or are they asking you to pay another way such as Western Union or a reload type card?  There is a way for scammers to spoof any phone number, anywhere at any time. Spoofing means they can show any number on your caller ID to pretend to be from that company or pretend to be a particular individual.

If "Ocwen" is asking you to pay through any other method than the normal bank servicing site, I susupect you are being scammed by someone pretending to be from Ocwen.

As to the rest of it, getting a modification done through Ocwen is almost impossible without the help of a good real estate attorney. Those games of loosing the paperwork are exactly what Ocwen does to completely avoid the modification. That is a large part of the reason why you need an attorney to help you with the modification. Make sure it is a legitimate attorney because there are people in the modification business that take your fees and never help. Get referrals from people that have been through the process with the attorney they recommend.
