In 2011 we were involved in a short sale of our home while our mortgage was under Litton Loan. We were then told that we needed to proceed with a deed-in-lieu per our contract because the home didn't sell after 90 days. We filed all paperwork and provided a move out date. After moving out Litton provided us with more forms to cover the move out and to insure a $3000 rebate for moving expenses. After waiting a month I contacted Litton to get a status update and was told that the title search was complete and we were almost ready to sign the final contract. Another month later I called to check on the status and Litton no longer existed. I called Ocwen only to find out that they had NO record of our Deed-in-lieu contracts and then we were offered a loan modification. Since we had moved out and acquired new bills we declined and asked to try and short sale again. They sent a packet but would never cooperate with our realtor. The packet was for after we had a pre-approved buyer and they told our realtor we had to send in this packet first. We went through 2 realtors who just gave up on us and told us that this was typical with Ocwen.
One year later we still have no deed-in-lieu as they continue to "loose" our packets and have no record of this request. They claim we aren't ever home to allow them to inspect the property. Litton had already done this inspection and most the legal work. They have had a "relationship manager" call every 2 weeks to get our number for this purpose 5 times. No home inspectors have ever called and therefore no completion. Now we have a foreclosure sell this week they say. I want to fight this because its wrong! Please anyone with any information on a class action suit, please get in touch with me. I would be happy to join.

Try to stop the foreclosure so you can have some time to fight this because once they foreclose it might be difficult. Call Ocwen today and ask for a modification. It will stop all foreclosure proceedings for a about 6 months to a year. They are playing so you have to know how to handle them. While you are doing the same thing by misplacing your modification papers gather you records from Litton loan to prove you case and then you file a case against them. You might even want to follow through with the modification to save the home and probably rent it or something, but in the mean time get all you documents and you records. and send all the copies to Ocwen. I was with Litton and now Ocwen also and I got a modification with them that took my mortgage from 1,600 to 631.00 it worth a try. I don't know what else to tel you. I just don't to see another mortgage company win by cheating someone out of their home.
