 On 03/12/2013, a vehicle insured by Old AmericanCcounty Mutual Fire Ins Company caused an automobile accident with my husband and myself. After making sure everyone was okay, I immediately called the police and started taking pictures of both my vehicle and the other drivers vehicle. When the police arrived, the usual information was requested from both parties. The girl that had pulled out within 10 feet of us was crying since she had just got the car a few days befroe the accident. She assured the police officer and myself that it was insured and produced an insurance card. I called my insurance company from the sith the TBIcene and got them started on it with all the information and had a claim number form her insurance company before we left the scene. My car was driveable but hers was not. Before the police left, they told me they ticketed her for No Drivers License but nothing else as I guess they  "felt sorry for her." After not being able to get in contact with her insurance for several days, I finally received a call early one morning taht went to voice mail. I immediately called back and got their voice mail. I called several times in the next few days but never got a call back. Finally, I called one last time and Statewide Claims answered the phone. I then got his e-mail and sent all the requested information to send the police report and the bill for getting my vehicle repaired. With all the back and forth and them not calling me back I put it in the shop under my insurance and paid the deductible to get it fixed after my insurance addjuster had checked it out. Afer a couple of more weeks of not hearing anything from them, i called my agent and she actually got him on the phone. He said his insured would not answer her phone, return his phone calls and all letters, regular and certified were sent back to him.  I told them where she worked and even gave them the telephone number. My insurance company then started subrogation with them to try to get the money back. On 04/23/2013, I got a letter from their insurance denying my claim since they cannot reach their insured. I have since talked to the Texas Board of Insurance and filed a claim. I was told by TBI that not being able to reach your insured is not a valid reason for a denial of a claim, especially with a police report done at the scene that clearly shows and states that the other person was at fault and where the other driver even confessed to the investigating officer that it was all her fault. We are not talking about a huge claim or i am not trying to claim any medical, but it is not fair that we pay to have all of out vehicles insured and then these companies like this try to get out of paying valid claims. At this point i am waiting to see what happens with the TBI complaint. If I get no satisfaction from them I have an agenda in mind which includes reports such as this and also all media outlets that are available to me.
