When I went online to double check my available credit I saw that we were over our limit. I knew we were close to our limit but certainly not over the limit. The bill was due on May 11th, which was a Sunday and I paid the bill online on Friday or Saturday, I don't remember which. When paying it a box appeared telling me that I should pay the 12.95 "RUSH FEE" to avoid it being late as it would not post until the 12th.

Well, everyone knows that Federal law states that any bill due on a holiday or weekend is not legally due until the next business day. I of course knew my legal rights and did not pay the rush fee knowing it would post in the legally allowed time.

When I called them this morning they said they would take off the fee, but they had every legal right to charge a late fee. I explained that this was not true and they basically told me that it was their policy but they would remove late fees if someone complained.

How many others are out there paying ridiculous late fees for this situation because they don't know they are legally protected or just don't bother to call. I am outraged that people act like this.

I have cancer and we obtained this card when our credit was less than stellar, but now that we have Capitol One cards this one will be paid off, torn up and closed. I will also be checking my credit report to make sure this has not damaged our credit that we have worked so hard to restore.

I urge all of you in this situation to file complaints and make sure they remove all late fees and adjust any reports to the credit bureau.

Orchard Bank does not credit your account for 2-3 days after your payment is made. It is very clear on their website. If you make a payment the day before, or the day of, you must pay the rush for it to post ontime.

Orchard Bank is one of those bad credit credit cards that do not charge for usual ontime payments. Many companies charge $5.95 - $7.95 each time you make an online payment. Orchard only gets you if you are paying so close to the due date.

Orchard Bank also gives you the option to pay the rush fee. If you are too close to your date, the computer will flag you about the rush option. If you are not too close to the due date, the computer does not flag you.
