The law offices of P. Scott Lowery first notified me on Friday, December 3rd. I talked to Ms. Smith, who for the most part was polite, until she thought I was talking too much and interrupted me asking if she could talk. She also got upset when I told her I did not know if I could come up with $1000 by Monday, but that I would ask my family. Ms. Smith also told me that I did not want the debt I should have shown more effort to avoid it. I told her she had no right to talk to me like that, that this was a debt I have been paying on for six years and any time I have had the money I have put some down to help pay off the debt.


The real issue arose on Monday. December 6th, when I called Ms. Smith back to inform her that I was not able to borrow any money, and that I was looking at my options of debt consolidation or bankruptcy. I am a hard ship case, I do not work and am in school. I literally have NO money. Ms. Smith told me that she wanted to talk to me about debt consolidation and put me on hold.


A Mr. Stanistoski, I do know if that is spelled correctly, but a manager with the firm, got on the phone yelling at me and said, " Ma'am do I understand that you refuse to pay your debt?". I asked him where Ms. Smith had gone, and he replied with he asked me a question. Mr. Stanistoski continued to yell at me telling me that "he was going to tell the laywers to file suit and that I thought it was funny and that I refused to pay." He continued yelling at me, and I must be honest, I yelled back, for around 30 seconds. The last statement I heard him say before I hung up on him was his yelling in my ear, " I will not be talked over! Do you understand me!?" I said a profanity relative to heck with this, and hung up.


I then called back, and informed Ms. Smith that I was recording the call. This time when I asked about debt consolidation she told me that it was completely my prerogative to choose to do so. When asked why Mr. Stanistoski got on the phone yelling at me she replied with, " I was right there, he never raised his voice, he had to pull the phone away because you were screeching at him." Funny, my friend across the room could hear him yelling at me. When I informed her of this she again told me that, "I had not shown effort to pay off the debt and not to call back until I had money." She then hung up on me.


I am not proud of the fact that I am in debt, with $0 income and no financial help, I do what I can to try to improve it and make payments. I have dealt with other collection agencies and have never been treated this way.

you can sue them cause there not allowed by any means to say there gunna sue you its againts the law for them to say that there was a guy who said it there and he got fired and sued for 6 million and won its like the fdcia act that they cant tell you there gunna sue

I read alot of compaints here about this so called lawyer he should of disbarred along time ago . I meant to say if any lawyer yelled at me like that over the phone I would of hung up on him then if he called again I would of dialed a few # infront of his # to block his # from calling my phone.

I never got a phone call from this office but when a collection agency calls my house I do not answer the phone I also don't answer to a# I do not know

File a Bar Association complaint immediately!!

The first thing you need to remember is to STAY OFF THE PHONE!!

NEVER speak to ANY third party debt collector on the phone. It will NEVER bring anything postive for you, and I can guarantee it will only make things worse.

File a complaint with the Bar Association as this is allegedly a law firm and they have broken the ethics requirements, and violated the law in the manner they spoke to you. It is a violation of the law for any debt collector to be abusive. Read and learn the FDCPA.

Also go online to FTC.gov and file a complaint.

Then go to some credit and collections websites like budhibbs.com, debtorboards.com, and others and get some insight to the sleazy world of third party collections and junk debt buying. This will open your eyes.

Communicate with them only via certified mail, return reciept requested, and be sure to put the certified# in the body of the letter to prove exactly what you sent. NEVER sign anything sent to a debt collector as they have been known you transfer your signature to other documents.

NEVER make a payment or an agreement to pay with any junk debt buyer or third party debt collector. ALWAYS make them jump through the hoops of the "validation" process.

Finally, if you ever do decide to speak with one of these bottomfeeders, remember it is all about control. YOU have to maintain absolute control when dealing with these freaks. That guy you spoke to was obviously an impotent little man who felt powerful browbeating a woman.

Misinformation

The best advise Steph gave was to stay off the phone.  No good can come from talking to any Debt Collector over the phone.  Unfortunately the rest of her information if she was serious was not wise or correct. 


It is not wise to threaten anyone that you are going to "hack their computer with a bad virus and they will loose all information".  First of all that COULD be seen as a true threat and handled criminally, whether or not you had the means to do it or not.  Second every lawyer keeps backups so if you were even able to do this anything that they "lost" could be recovered in probably under 1 hour.


As for the Cease and Desist letter, not only is that incorrect terminology it wasn't even spelled correctly.  If you sent that to them they would just laugh.  The term you are looking for is a Cease Communication letter.  Now, all this will do is keep them from contacting you on the phone.  It won't stop any other action they may decide to do.  The best way to send this is by Certified Mail with Return Receipt.  This way you have proof that you not only sent it, but they received it.  On the Letter do not sign it(so they can't copy your signature), write the Certified Number on the actual letter.  You can search the Internet for several Cease Communications Templates.


If this debt is still legally collectible, and you don't dispute it.  You can then send them, in writing, a settlement offer of what you are willing to pay.  Also, that you will only pay them by Money Order(so they don't have access to your account).  Only when you get something from them in writing do you end them another dime. 


You may also want to read up on the Fair Debt Collection Practices Act(FDCPA) as to what 3rd Party Collection Agencies can and can not do.

Stay off the phone

If any attorney yelled at me like that I would of threatened to hack thier computer with a bad virus and they would lose all imformation  and it would also cause bad damage to the hard drive as well.

The next time they call do not answer the phone. I would send them a cease and disist letter certified or you can fax it to them 100 times every half hour until the ink jet runs out and it says fax error
