2 days before thanksgiving, My dog came down with parvo. I called around several vets & this one said they were all about animals, and not about the money. I took my baby into the vet, and they quoted me $300 & that I had to pay $150 up front. Which I did. They said they would not need to keep her for very long since she just had gotten it. 3 days turned into 6.

 And when I went to pick her up, my balance had went from $300 to almost $600. In which I had already paid $150. They didn't even touch her the last 3 days, and charged me over $200 just for boarding. Yet, they aren't about money? Then I asked, look this turned out to be way more that what I was told, Can I pay you the $150, and make payments on the rest. I was told my dog would have to stay there, and boarding fees would be racked up.They would keep her 'hostage' I was told. I did write them a check for almost $400. I knew I would have a few days to find the additional money to the $150 to cover it so my account wouldn't bounce because of their greediness. A few days passed, and I ended up stopping payment on the check. When they called me about it, I told them what the situation was AGAIN, and why I did what I did. The $300 had turned to $600, when they hadn't even touched her the last 3 days, and they refused to work with me. I told them I would be in to pay them in 2 payments. They REFUSED that.


From then on for 2 months they harassed my almost 70 year old mother in law, threatening me via voice mail & mail. They even stooped to taking an envelope doodling on it , saying I miss you, covering their name & sending me a letter. I would have opened the letter regardless. Now , I got a letter 2 weeks ago, that said I had 10 days to contact them to work something out. 2 DAYS after I received that letter, and officer contacts me saying I am going to be arrested. What happened to 10 days?!? And something could be worked out?!? This officer says I did theft by deception?!? I paid them HALF $150 up front. I didn't deceit anyone. And I can prove I had the additional $150 in my account the day I picked her up,which they refused because it wasn't in full. This place has harassed me, my family. And now has refused to take payment from me. They want me arrested for false accusations. I will pay them , like I said I would. But what is one to do when they refuse it again?

Yes you did deceive someone, when you stopped payment on the check.  In many cases this is actually a criminal(arrestable) offense.  Especially if they can prove in some way that you had that intention when you first gave them the check.  If law enforcement has actually contacted you, you have a serious problem that is not going to go away.  Will it actually end up in you getting arrested..impossible to tell you, but at the very least you are probably still going to get letters from them and they may decide to sue you.

You said you had $150 in the account..that doesn't matter.  Do you know how many shoplifters have the money to pay for the items they steal?  No, I am not calling you a shoplifter, just pointing out that your claim doesn't really matter.   You basically owe about $400, and say you had $150 of that.  This leaves you with about $250.  Now, this happened two months ago and if you are really going to pay it..have you done anything in that 2 months to not only put the $150 aside, but save up the remaining amount to pay them.  If so you may want to try something like sending them a Certified Letter(with Return Receipt and Signature Required) with a check for the partial amount and a promise to pay the remaining amount, and even better a schedule in which you will make the payments.  If they cash the check it would then be just about impossible for them to claim that you aren't making an effort that they would accept.  If they return it, you could keep that as proof as you are at least making a reasonable effort.

One other thing that you didn't mention.  In some jurisdictions if you write a bad check(and yes stopping payment qualifies) entitles the company to not only go after you for the amount of the check but "penalties".  Depending on the jurisdiction it may just be a return check fee, but in others it could be as much as 3 times the amount of the check.  So if they are still only going after you for the face value with no extra fees..you may want to think about what your delay may actually cost you.
