Not being a lawyer myself, I cannot offer any legal advice here. However, I can most certainly say that Palisades collection company is run by bullies who are evasive at every opportunity that one partakes in an effort do determine where one's supposed debt came from that Palisades is trying to collect. Simply put, I have dealt with this company myself and attest to the fact that they should be shut down as soon as possible for ruining individuals' credit reports. However, I am unsure of how to do this and could use any advice. Thanks

All the credit companys have removed it for my report. my post that started this whole bash fest was from feb 2006. some people never looked to see that it was an old forum. have a great new year kid.

You people that are just bashing need really to get a life. Telling me that i cant do this and cant do that. You all sound like the kid that use to get off the school bus then wait till the bus starts to pull away then yell to the kids on the bus that you want to fight. then run home to mommy. I will not respond to anymore hate from you a*&*&*s.

To the people that have tried to help i thank-you.

Its a shame that someone cant have ADULT responses on this site without bashing. Why are you even in my fourm if you have nothing to add? Start your own fourm and call it losers are us. or assholes are us. If any of you haters would have looked at my first post it was in february 2006.

In my last post i also said that it was removed from my credit report from all 3 credit companys. So now that it is 2008 there would be no reason to file a class action suit. Assholes remember to read all dates first. To the people here who were here to help, thank-you and not all people on here are a*&*&s like these couple of losers. good-bye losers

Not at all. But I've had my share of appearances in various courts.

Folks need to understand just how the class action process works. It's been my experience that many folks are all to eager to jump on the "class action lawsuit" train as long as SOMEONE ELSE IS FRONTING THE COSTS and doing the "leg work."

This OP falls into that category. If you think I'm wrong Tony, just google e-loan class action to see a CURRENT example of what the difference is between a "lead plaintiff" and "non-active" plaintiffs. The lead plaintiffs normally receive a significantly larger settlement than the remainder of the class plaintiffs. THIS IS FACT.

If Todd has such a good case for himself, he should retain an attorney and file an individual suit rather than blather about the internet hoping to get a $25 gift certificate from a class action lawsuit where someone else has done all the work.

I am no lawyer wannabee, but I'm educated enough to know that if I have a valid case against someone or some business, I pursue it directly rather than hoping someone else will go after them and leave me some scraps.

In almost all cases, an individual plaintiff who wins gets a larger personal settlement from an individual lawsuit than from a class action suit where they are not the lead plaintiff. People need to understand this and become PROACTIVE in seeking redress.

I'm still waiting for Todd to announce that he has hired an attorney and filed his lawsuit.

A few observations and suggestions

Disputing credit innaccuracies is FREE and can be done online with at least two, if not all three of the major agencies. Since people reading this complaint obviously have a computer the arguement that they "might not have the means or resources" is null.

Steve, Steven, Faron, and many others that have posted here are regulars and do not trash people or "work" for the companies you have complained about. We do not always agree, but they are honest.

IF BILLCOLL01 agrees with you...then you have 0% credibility!

Class action lawsuits, although meant to punativily punish the company at fault....in the end only make the lawyers rich. I have been involved in two recent ones...the SDRAM case involving chip manufacturers (Micron in my case) and one with Visa involving overseas credit transactions and fees. I will recieve less than a thousand dollars in the first case and very little in the second, but the legal fees in both cases are in the tens of millions of dollars.

Bud Hibbs and Robert Paisalo are both good resources for fighting bottom feeding third party junk debt collectors.

wow hay nathan did you read all this..sounds like there are more then one scum sucking blood jack a##'s around... i am dealing with unifund that sounds like the same thing on here.. they are trying to collect on a debt that was deleted from my credit file now 3 years ago and it is past the sol of collecting on it.. i think both these collection companies need to be out of bussiness and leave people alone.. they need to go out and get real jobs.. i suggest that every one needs to put in a complaint against collection companies to the attorney generals, the federal trade commission, the bbb, the department of commerce, all in your state.. thats what i did and i have not heard a thing as of yet and i was servered with some kind of court papers with no court date on them way back in dec of 2006.. i also know a lady from my home town that they did get into court and the attorney for this UNIFUND collection company he NEVER showed up for court.. so best of luck to you and everyone on this site needs to chill out.. they cant get blood out of a turnup....good luck!!!!!

And, yes it does matter to me that people continouosly spout off with "just file a class action lawsuit", etc. It is irritating when people spout off with such stupidity on a daily basis here.

My reply was not to bash anyone, but rather to educate them on the total waste of time a class action suit is for the consumer/victim.

We are talking about collections issues here in which debtors/consumers have many more viable avenues to take to get justice, and get paid too. It is all about education.

I have never seen a site where people attack each other like in this site. I thought this site was to help people? the above was just for fun as i thought i should show the attackers how it feels. I do really wonder after looking up the record of palisades why anyone would defend this company. As for you todd, Take care of yourself cause this site shows how many haters are out there.

You asked a question and received some good, factual answers. Here's a mini-class action lawsuit lesson for you. It should help you to better understand the class action process.

Why not? I have never heard of any class action lawsuit whereas the plaintiffs, upon winning, were given a gag order as a condition of the settlement. Name the lawsuit that you were part of please. Also, class actions lawsuits, once settled, are a matter of public record. Kindly explain why you can't mention the company and class action lawsuit you allege to have been part of.

Also, except for the LEAD PLAINTIFFS, the other plaintiffs don't have to "sign up" for the class action. As part of the judicial process, the records of the defendant will be used to form a list to NOTIFY all members of the class of their option to join the class action or to opt-out if they should choose to pursue their own individual suit. This is part of the reason that class action lawsuits, with many plaintiffs, require a lot of UPFRONT MONEY to cover these types of costs.

This is true in part. The LEAD PLAINTIFFS do the "leg work" as you call it. The remaining class plaintiffs only have to respond to the class action notice they receive and sit back and await a judgment.

So why did you come asking for a lawsuit to join? Seems to me you should just go find a lawyer and file the class action suit yourself. Further, as the LEAD PLAINTIFF you would normally receive a larger settlement then the "non-active" plaintiffs. If you research the E-loan class action lawsuit, as part of the proposed settlement, the LEAD PLAINTIFFS (group of plaintiffs who did the "leg work" and paid the UPFRONT EXPENSES) will be receiving about $20,000 MORE than the remaining class plaintiffs in the suit. Also, ONE LEAD PLAINTIFF (the person who initially started the class action) is proposed to receive about $40,000 more than the normal "non-active" class plaintiffs.

""A class action Lawsuit is a very cheap way to sue someone. Most lawyers that like the case and take it will do it free of charge and take 40%. Look at the case against Equifax. cost us Nothing.""

Incorrect. Just the opposite. It's usually very expensive. A class action is a way for multiple plaintiffs to SHARE the UPFRONT costs of bringing the suit and to reduce redundant lawsuits. THE LEAD PLAINTIFFS normally front the the initial costs. There are COURT COSTS and the time and expense of NOTIFYING CLASS MEMBERS of the action. This NOTIFICATION requirement of a class action may often cost over a million dollars. This is why it is customary for the LEAD PLAINTIFFS of a class action lawsuit to receive a significantly larger settlement than the "non-active" plaintiffs. Again, research the E-loan class action for a current example of this. The "non-active" plaintiffs do NOT share in the costs of bringing the action so they receive a smaller settlement than the LEAD PLAINTIFFS.

As a "non-active" class plaintiff, you don't have to spend anything except your time. You receive a notice. You fill out, sign and return the required paperwork, and wait to see what the court is going to do. HOWEVER, someone DID have to foot the bill for the court costs, research, compiling notification lists, action notices in newspapers, and mailings to members of the class. In many cases, one or more LEAD PLAINTIFFS pool their resources to PAY THESE EXPENSES, and are referred to as LEAD PLAINTIFFS. They receive a significantly larger settlement then the remaining "non-active" plaintiffs.

I responded as I did because you went about calling names and posted a veiled threat to the folks who posted rebuttals that did not support your cause as you hoped.

I posted information as to what legal motions you or anyone else would have to go through to take legal action against any other poster.

You post in a public forum, you receive rebuttals that gave you some pretty accurate information about class action lawsuits, and you respond with name calling and threats.

If you're going to threaten folks Todd, you should expect some rebuttals. If you can't take it, don't dish it out.

Let us know when YOU are going to be one of the LEAD PLAINTIFFS in a class action lawsuit, rather than waiting for other folks to do the "leg work" and front the costs.

Palisades removed the item from my report after i disputed it with equifax and the other 2 and had my lawyer send them a warm letter LOL. My whole point was that i have the resources and contacts to fight these companys but some people dont have that option. I am not here to bash people or play games with people. I like this site cause it helps many people. As for you Robert from Buffalo what is your point for coming into someones forum and bashing them with useless information? Did that get you off? Steven I apologize for jumping on you like i did. I just in here trying to help others.

Well, this page has been entertaining to say the least!
I may have a reasonable suggestion for you Todd. You can go online to the three credit bureaus and dispute the charge from Pallisades Collection. All that you need to say in your dispute is that it is an invalid charge. Keep it simple, anything too in depth will hurt you more than help you. If Palisades "verifies" the debt with some sort of documentation or old bill, you can simply provide this to AT&T to validate that it is not a true bill owed. It's up to you if you want to provide a copy of this validation to Palisades, the Attorney General and/or the three credit bureaus.
In any case, this can easily be rectified if you just know where to start. I hope you find this helpful. Thanks.

Steve is from Bradenton FL and I am from Jacksonville, FL. Break out your map. If you think we are the same person then please turn us into Ed to.

If you feel you are being wrongfully sought for non payment of debt. Then type up the old cease and desist letter (check into laws pertaining to SOL). Next if they threaten to sue. Have them take you to court. When you get the paper work from the judge, respond telling him that you have not received the required proof of the debt. He will probably have them provide it. You should make plans to show up in court if you are sued. The amount in question is in the small claims limit so they should just be taking you to small claims court anyway. If you have not received the proof as required let the judge know and they can ask them for an explanation. Check into that side.

Also before screaming class action lawsuit. Write a complaint to the State Attorneys office in the state where Palisades is headquartered and report their violations (if any under the Fair Credit Reporting Act). The state attorneys office can do an investigation and fine them accordingly (you get part of the fine). You don't have to file a class action lawsuit.

Check out posts under Allen Lewis and Associates and you can see where they settled out of court and paid a few hundred people back that they had been harassing. Once again no need for class action lawsuit. If you feel this applies check it out.

What did ATT and/or Palisades do to justify a class action suit. Next break out you calculator and do some math, Figure what you think the damages could be. Check with you lawyers to see how much money they plan on getting. Break the rest up into shares for everyone that files.

If you don't believe anyone like Steve and Stacy then look into some other class action lawsuits and break down the numbers.

The only time anyone has made any kind of money from a class action lawsuit has been when the number of people on the suit are few in numbers. Like say a class action lawsuit involving sexual harassment at a work place when there were 20 or 30 victims that grouped together and achieved class action status for themselves.

Look at what the attorneys got compared to the people that won.

Next look a larger class action lawsuit against say Bellsouth (now AT&T) about billing practices or whatever. Hundreds of thousands (if not millions) were involved and got say 10 or 20 dollar credits on their next bill or something. The lawyers got the rest.

First of all, I do not work for palisades collections or any other collection agency. Not now. Not ever. You must be new here, as I have literally thousands of posts and rebuttals here on Rip Off report BASHING collection agencies, junk debt buyers, and the lawyers who defend them.

Second, I NEVER defended Palisades in any way. I simply told you that you were uneducated in regards to "class action" lawsuits. That was it.

Too many people here on ROR know me. They have followed my posts for years. Some agree with me, and some don't. But EVERYONE here except YOU knows that I do not work for any bottomfeeder, or AT&T.

I just said I don't support people screaming "class action" every time someone annoys them! There is no way I would defend a junk debt buyer. I am a BIG fan of Bud Hibbs and for people to be careful with dealing with these type of companies. As far as this company having so many complaints against it, I believe it. When you buy old, out dated debt for pennies on the dollar and then try to strong arm people into paying, people are going to complain. I would, too. But I am simply stating that class action is just not the smart road to travel with these guys. Nowhere in my post did I say anything good about this company.

As far as being on "your" forum? Guess what, this is a website that is not owned by you. The "rebuttal" and "consumer comment" options are there for people to use for a reason. I like to read the reports on here, because sometimes I can either a. learn something or b. offer helpful advice like that class action lawsuits are generally a pretty big waste of time.
I live in Latrobe.. which is about 40 mins away from Pittsburgh on a good day depending on the tunnels. I am a stay at home mom to four. If you want to come visit and see for yourself that I do not work for this company, or any company for that matter, I suggest next summer. We always have lots of people over during Steeler Training Camp.

As far as you personally attacking me and calling me scum, wow. You need to grow up and stop lashing out at people just because they don't agree with you.

Palisades has had many complaints. Why dont you do your homework before you open up your mouth. NJ Attorney Generals Office Fined them and has had hundreds of Complaints against them.
Why dont you google their name or go to bud hibbs and see how many people they have ripped off.

My case is that i had an AT&T account in 2001 and it was paided in full and never late ( I have an 800 credit score). Around 5 years later they sent a letter that i own them around $400. I still to this day have AT&T until they merged with verizon. When i asked them for verifcation they sent me an old bill with my name on it. AT&T said they have no record of me owing anything. They have to by law show you something that you signed or a contract. which they had none. When i call them now they just hang-up. they never call or write me. they know that they are wrong but they could care less.

I just dont know why someone that has no interest with Palisades would care what is said about them.

I just called Palisades 800 number and its really funny that in their directory for their list of agents they have a Mellisa and steve that both work for them. you two people are real losers. trying to bully and give false information out to the public. Palisades has been sued many times and has lost. They are not allowed to collect in many states. If you have a problem with them please contact your Attorney Generals Office ( Believe me they have them on file) and please file a complaint against these bloodsuckers. Please also go to Bud Hibbs web site (budhibbs.com) Bud has lots of information about these bloodsuckers. Also AT&T DID USE Paisades to collect for them in the early 2000's around 2001-2004+. Believe me you can sue them and win. Google everything you need and there is help out there. You wont even need a lawyer ( maybe just to file your paperwork) good luck and sue sue sue these scum.

I was just part of a class action suit against a giant company ( cant put name on here) and over 10,000 of us won $368 each. Not much money but put a dent into the company. It makes me crazy when I read this crap where the first response is "I want to file a class action lawsuit", etc. This comes only from the uneducated who have absolutely no idea what is involved in a class action lawsuit.

Class action lawsuits are VERY expensive! Usually MILLIONS of dollars when going up against companies of this size. And, guess who pays that bill? YOU DO! And, that money is UP FRONT. Nobody does "contingency fee" class action lawsuits.

Now comes the worst part! After YOU have spent MILLIONS of dollars, guess who the ONLY ones to make any money are? Thats right! The lawyers!

The class action participants usually get nothing or next to it. It is all about the lawyers getting rich. That's it.

Not so much ATT

I called ATT and they do not use Palisade as a collection agency. They are not an approved agency. So, I'm not sure that ATT is at fault, but that's for a lawyer to decide. I am looking into filing a class action suit right now. I will post when I find out more.
