My wife Deborah received a letter from a local attorney
soliciting business September 6 from a public record that Portfolio Recovery
was suing her. I immediately called Portfolio Recovery and set up a payment
plan with the understanding that we would pay $469.02 immediately through a
bank draft and $67.01 a month auto bank withdrawl.  I was assured that we would be sent papers to
sign and as soon as they received them back they would notify the court. I was
also told the phone calls would cease. My wife was served anyway to appear  in court on October 19.2012. I called
Portfolio back on or about 9-24-12 explained the circumstances again and was
told "if we had paid our bills none of this would be happening" and "anyway we don't drop cases in Florida" even
though they had already taken out 469.02 on 9-11-12 and that the lawyers were
all very busy.In the meantime no papers arrived.Called again 10-01-12 and spoke
with a supervisor Tera. I was told that the papers probably won't arrive in
time to avoid going to court.( Also 10-01-12 the draft of $67.01 was taken out.)

I was told if the papers don't arrive then they would have to be signed in
court. So now I have paid a total $536.03 on a $2100 amount and it just keeps
getting worse. Each time I have called and been told something different. My
last conversation with Portfolio I was told to call the clerk of the court here
and tell them we arranged a payment plan. Which I also did and was told
Portfolio's attorney had to notify the clerk's office an agreement had been
reached. I was told by the Clerk's office not to trust Portfolio. That she had
had been around a long time and don't plan on getting the papers in the mail.  All through this entire thing I told them repeatedly that my wife had several chronic illnesses and as I am the only wage earner I really didn't want her to go to court. The usual response to my concerns was then don't show up and we will get a judgement against you. Funny their motto is "We're giving debt collectors a good name" Really?
