York City Police knocked at my door and handed me a Complaint form to be sued in Court because Porfolio Recovery Associates could not contact or reach me via phone or regular mail about a HSBC debt of $4,651.26.  Called 866-428-8102 and made arrangements to make automatic payments of $50 on 1/24/12 and $60 on 2/28/12; but was transferred to ID #301 who said "good luck" with court proceedings and can't guarantee $60/month will be enough to stop legal proceedings; but need to pay $138.79/month in order to pay debt off within shorter time frame due to PA law.

#2 Consumer Comment

You probably just screwed yourself

AUTHOR: Robert - (U.S.A.)

Okay if you don't get anything else from these comments get this...

REGARDLESS OF WHAT THEY SAY DO NOT MISS THE COURT DATE

Because if you don't show up in court they can and will get a default judgement against you.  This also includes making sure you file any answer/response that may be required.  Because if they get a judgment they will be able to take further action.  It does not appear that PA allows Wage Garnishment in this case, but they may be able to attach your bank accounts.

Now why do I say you may have screwed yourself.  Because you may not have legally owed the debt.  There is something known as the Statute of Limitations, for PA this is 4 years.  So if you haven't made a payment or had any other action on that account in the last 4 years you may have been able to walk into court, shown that the debt is outside the SOL and basically walked out not owing a thing.  But since you have now made a payment you may have reset the SOL and that $50 may be enough to cause you to owe the entire debt.  My guess is that you called them, and they said to make a "Good Faith" payment to show you are serious about paying back your debt, you got "scared" about the suit and decided to pay them.  While it's too late now the only thing about these "Good faith" payment is that you can have "Good Faith" that you will be sued for the full amount.

However, now that you are in this situation you may still want to at least consult a lawyer to see about your options.   It may cost you a couple hundred dollars to see a lawyer, but if it saves you over 4K it will be worth it.

Baring that when you go to court try to come up with what you truly can pay, keeping in mind that paying back $50 a month probably isn't going to cut it.  As that would be about 92 months.  Where the $138 puts you around 3 years which is a little more standard.

Good Luck
