i was first contacted by portfolio recovery last month, jan of 2008. i answered the phone not knowing who it was. i just told the man i had no money. i got another call today, feb 25, 2008, but i did not answer it after reading all of the posts on this website. this is an old debt after my divorce in 1990. anyway, went on with my life, forgot about it unitil i remarried. i knew it was on my credit report, but it disappeared from my credit report about 1999 or 2000.

my concern is after reading all of these posts can they reage the account? my credit is good now. i did pull my credit reports today and did notice that transunion showed an inquiry from porfolio recovery. how can they reage an account? where do i get the necessary documents that i have read on this website? i dont want them to ruin my credit that i have built up over the years. any help you can give me would be greatly appreciated. thank you.

Peanut,

First, go to FTC.gov and file a complaint online for the illegal collections activity.

Second, write a letter of complaint, and dispute to each credit bureau for the ILLEGAL inquiry. This inquiry is illegal because they do not meet the requirement of "permissible purpose" to check your credit since the "debt" is not legally collectable. You can bring suit against them for this.

Third, send these bottomfeeders a DISPUTE letter and clearly explain that the debt is legally uncollectable and all collections efforts must cease. Also inform them that they are not to access your credit any more, and that doing so will result in criminal prosecution and lawsuit.

Do not sign anything that goes to a bottomfeeder.

Send all communications by certified mail/return reciept requested. Be sure to put the certified mail # on each letter itself and keep a copy of each for your records. This procedure is very important.

Have fun with these morons, and then sue them.
