On January 23, 2014 I purchased a 2007 Toyota Prius from Prestige Auto Sales, LLC. Approximately two weeks later I received the car from them. It was shipped from one of their other business locations in Hollywood, Florida. Upon receiving the vehicle I then took it to a local Toyota dealer to have the car fully inspected. As a result of the inspection it was determined that the vehicle had a leaking water pump and a defective ABS Brake Actuator Assembly which needed to be replaced.

I contacted Alex and informed him of the problems that my Toyota dealer found and I faxed and emailed him a copy of the repair estimate from the dealer. A few weeks after that I had the water pump repaired at a local auto repair shop and paid for the cost of the repairs out of my own pocket. The repair bill was $276. I then contacted Alex again and he assured me that he would work with me to resolve the problems with the vehicle. Alex agreed to send me a check in the amount of $276 to cover the cost of the repairs on the defective water pump which he did. Alex also told me that he was going to find me a used ABS Brake Actuator Assembly and that he would also pay to have the ABS unit installed in my vehicle at my local auto repair shop.

After waiting two more weeks it became apparent to me that Alex simply did not care about resolving this issue as I still had not heard from him during that time. I then located a used ABS Brake Actuator locally and emailed Alex and informed him that I had found a used ABS part for $275 and that the labor would cost $300 to install it. In order to resolve the issue as it had now been almost two months since I purchased the car from him, I suggested that he simply send me a check for $575 to cover the cost of the used ABS Brake part and the labor charges. I sent Alex and email and he agreed and that he would mail me a check for $575.

Alex claims to have mailed the check to me on March 19th per his email to me. Today is March 26th and I still have not received the check from him. Alex lied and he never sent the check to me. It only takes 4 days for a check to arrive from Hollywood, Florida to Goose Creek, SC. I have sent Alex three emails through eBay over the past three days and he has not replied to any of my emails. I plan on leaving him negative feedback on eBay if the check does not arrive here by Friday March 28th.

Why didn't you inspect it "before" you bought it?

You state that you had the car inspected AFTER you purchased it. You should have had it inspected by your mechanic BEFORE you purchased it.

Was there any type of warranty such as 7 days, 30 days, 3 months? If no warranty at all, buyer assumes the responsibility for any problems because you purchased it *AS IS* meaning you purchase it just the way it is and you MAKE the repairs.

Now what kind of warranty are we talking about here??

If the dealership has promised you they will repair it and you have emails stating that fact, you could go on your 6 o'clock news cosumer program and see if a local reporter can make them stand by what they promised.

Obviously this is the dealer replying under a fake name.

I was given a verbal and written commitment by Prestige Auto to pay for the ABS Brake Actuator and labor costs in the amount of $575.

I was told on more than one occassion that a check had been mailed when clearly it had not.

If and when I receive the check from them I will gladly remove the initial comment and report against them.

As it stands now THEY have missrepresented the vehicle and they have also not honored their word by agreeing to make things right and agreeing to pay for the ABS Brake part and labor costs.

When someone says that they are going to make things right and agrees to saend you a check and then lies about it what would you assume???

My report stands until such time when I receive the check for $575 from them.

 You do realize that even internet blackmail IS blackmail. You havent even given it a week and youre online posting your problems. AS IS means AS IS. You cannot blackmail them 2 months after a purchase and expect them to be responsive. It was a USED vehicle. If you wanted perfection you should have purchased a NEW vehicle. But you didnt want perfection, you wanted CHEAP. As such your CHEAP is really showing.

I mean really!! How self entitled are you?? There comes a point where a business can no longer bend over backwards and give you your way. Thats what you are trying to do. GET YOUR WAY. No matter what the costs are. Did the dealer by chance possibly give you a "we owe" slip?? If not then what you have done is a form of extortion. You then compound the issue by posting it online. The web is a media outlet and you can be sued for placing your opinions as fact.

The only fact that a court of law will look at is if there is ANY paperwork with YOUR signature on it that states your purchase is "AS IS". If so then you will have commited a form of blackmail and a form of extortion. We are getting younger and younger judges on the bench. Judges who know what email and the internet is. Actions such as yours are NOW being prosecuted more and more.

What you call "making right" the law calls theft and fraud on your part, so be careful. Make sure the paperwork you have doesnt state "AS IS" or you could be in some serious legal and financial trouble. If you do not have a "We Owe" slip, which is a dealership admitting there are issues and they are going to fix it without any costs to you, then by making this post you will have shown a pattern of behaviour. A pattern that includes blackmail, extortion and fraud.

But im a betting man and Im sure you will find a way to justify your actions even if they do sue you. THEY will be the monsters and the evil dealership while you will sit there and play the poor little victim. Consumers like you are so self entitled that the very thought that what you are doing is illegal never crosses your mind. And when you are told it is illegal, you dismiss the information, falling back on the victim card. Pity poor you.

Unfortunatly, your idea of "making it right" and what the dealership is allowed to do by the terms and conditions of the contract you signed are two entirely different things. Each and everytime you demand something that they cannot do by those terms puts you that much closer to litigation.
