I'm sure this won't go in my favor..but...
I asked another driver to take my HONDA PILOT to Dallas Airport and drop off my family and friends. On I35, Denton Tx, there was a 5 car pile up - no one hurt and police told everyone to exchange insurance information.
My HONDA was in the middle - damage to front and back. All witnesses, and the Progressive driver, said the car slammed into the back of my car and pushed the HONDA into the next car -

Progressive investigated - told me to meet them at the body shop - arranged a rental - I took the afternoon off to do this - when I get to the body shop there are 3 Progressive reps there. Look at the damage to the HONDA and say that there is not enough damage in the rear to justify the damage in the front and they will only pay for the rear damage.

I told them maybe that's because a 1999 Toyota rammed my 5 Star Safety rated vehicle. DO they have pictures of their car that rammed me to see how fast he was going at impact ?....No they havn't gotten around to that yet !
Nope....

Well...I refused the settlement and turned it into my insurance. Waiting on their investigation results.
I ask someone to drive my car, so I don't want my insurance company to go after the driver of my car and I will probably end up paying my deductible and have my rates go up.....BUT ....I just want the insurance companies to treat us fair...that's all...FAIR !!

update from MY insurance carrier

My insurance carrier inspected the HONDA - said the estimate Progressive wrote to repair the rear of the vehicle would not come close to covering the actual repair.
ALSO that the HONDA has a great reputation for being a sound and safe vehicle. The Progressive reasoning of not having enough damage to rear of HONDA to justify a hard hit from Progressive driver would not hold water with them.
Now I wait again. But at least my carrier inspection justifies my earlier thought that the Progressive people are ignorant and sleezy businessmen.
By the way my lawyer said the only way he got Progressive to pay up is he had gotten signed statements from witnesses at the scene of his accident when it happened. Progressive didn't even try to contact them to see what the real story was.

I am a FORMER customer of Progressive Insurance and know EXACTLY what you are going through. I was involved in an accident a few years ago and Progressive was my insurer at the time. I was sitting STILL, waiting to turn, and another driver, coming the opposite direction, crossed the yellow line and hit me head-on. This happened in Kentucky, which is a no-fault state. Meaning, you pay for your damages and the other driver pays for theirs and nobody is cited. I think its bulls***, but what can I do. My car was only 2 years old at the time, and the driver that hit me was driving a 1986 Nissan 300ZX.

Needless to say, neither vehicle was drivable, and mine was towed to a local repair shop. I called Progressive as soon as I got home to report the accident. They said they would send an adjuster to the repair shop the next day to assess the damage. About a half hour later, I get a call back from Progressive, telling me that "it appears your policy has been cancelled for nonpayment." I was shocked and knew that that was impossible. I had paid the premium, albeit late, but still within the grace period. They stated that they got it "a day late" (meaning a day outside the grace period, again, I knew that wasn't true, because I mailed it a day INTO the grace period). Of course, they KEPT the payment...they didn't deny the money...noooo. I demanded to speak with a supervisor, and they were of no further help. I could see where this was going.

To make a LOOOOOOONG story short, I had to get a lawyer and sue them. In the meantime, I had to have my car repaired with money out of my own pocket, so I had transportation. It was a Chevy Cavalier, and I know that they would have totaled it, since there was so much damage. However, I paid about $8000 to have Humpty put back together because it took a YEAR to get to court! Yes, that's right...a year. The accident was in October and we went to court the following December (14 months later).

Not only did I get my $8000 to repair my car, but I also got punitive damages in the amount of $4000 from these sheisters. The judge didn't buy for a second that they received my payment late. He told their representative that there was no doubt in his mind that if I hadn't had this accident, my policy would have rolled on with no problems whatsoever. They just didn't want to pay the claim.

That's the WRONG time to find out that your insurance company sucks!

One thing that drew me to Progressive to begin with (aside from their low rates - now you know why they're so low...they don't pay claims!) was because they cut you a check right on the spot when you have a claim (usually). UNFORTUNATELY, we had to use this once when my husband scraped his new truck against the side of our house because he didn't judge the distance properly (it was a big truck). Progressive came out, looked at the damage and "decided" that it would cost $1800 to fix. They cut us a check right there for $1300 ($1800 less our $500 deductible). We thought, GREAT, we don't have to wait, we can go get it fixed!

WRONG!! We couldn't find ANYPLACE that would fix it for $1800! Not even close! The cheapest we found was $2100. That meant we had to come up with an additional $300 (for a total of $800 out of our pockets) to get it fixed. Is that fair? No, but then again, as you stated....Progressive isn't fair! LOSE THEM QUICK!
