Progressive Insurance Lawyer informed us Progressive is one of top three worst Insurance Company's in the USA. San diego, California

On June 07, 2011, our son Vincent was coming home from school and was sitting at a stop signal. A woman who was coming from behind was texting and hit him going 50 MPH. This caused his car to smash in to the car in front of him and that car in front of them. His car was totaled. It's now Thanksgiving and we haven't received a dime fro the woman's Insurance carrier..PROGRESSIVE. Regressing, we had to hire a Lawyer because we found out the woman didn't have enough coverage to pay for my sons car. We are forced to sue Progressive for the Liability part to get enough money to pay for the totaled car. That's yet a another story yet to come. Our Lawyer informed us that Progressive is the worst company there is to deal with and he has been doing this for 27 years. Here's what they do, demand you pay your premiums, if you fall behind they cancel you. If you file a claim they will drag it out until you either give up or except pennies on the dollar. That's their M.O.
He also informed us that in California, Insurance Companies are not forced to ever pay. They can, in fact never pay. He told us they can drag their feet for the next 3 years and there is nothing we can do. The Insurance Commission is a paper tiger that he said NEVER does anything to prosecute Insurance Companies for negligence. So here we sit, out $12,000 and no end in site.

He also informed us that in California, Insurance Companies are not forced to ever pay. They can, in fact never pay. I really hate & despise progressive insurance. We had to take them to court but they didn't "WORK" to try to make them pay for our totaled car. They still continue to fight paying even after putting the blame on their insured. When we went to the judges office in their county he said he was friends with them.
The judge should had taken himself of the case because this was "Conflict of interest", this cause a lot of emotional & undue stress. Progressive lawyer talked down to me & still said i hit them & wouldn't stop when they was backing out of their driveway.
The other driver back into me after i cleared a stop sign. I had the right of way & i didn't have to stop since i was already moving i was only doing 10mph.
The other driver didn't look at any traffic that was coming. The balance on my car loan was $16,000 due to late fees, it took from 10/2003-08/2005 to settle because they knew their insured was "At Fault".
Of course the assholes blamed us for everything. We threaten to appeal the judges decision & progressive decided to settled. My finance company had to settle for $5,000 & we still had to pay $1200 of that.
Progressive should had been made to pay all that $5,000 after all the mental anquise they caused. Their a bunch of pigs & thief's.

Refresh my memory, Charles. From WHICH college did you graduate in order to receive your degree, either in Business Administration or Political Science ??? Hmmmmm???? Yeah, I thought so ( or, rather I KNEW SO, seeing as how you BOUGHT a "high school diploma" online - you admitted this fact in a previous post ).

The insurance commissioner doesn't never do anything for the consumer. They never hold insurance companies accountable. I would "LOVE" progressive & statefarm & all state to get theirs & get justice.

Excellent advice. Tell your attorney to either fish or cut bait on this one. If he gives you any grief, just find an attorney who WILL get up off his duff and get your money for you.

If your lawyer is not down at the local courthouse filing a suit against the driver...get a new lawyer.
If your damages are only $12,000 and the woman didn't have enough coverage it sounds like the person had the minimum coverage allowed by law which in CA. Unfortunately if that is all the insurance she had, that is all Progressive is required to pay.
This is why you need to file a suit against the driver. If she has a job you may be able to garnish her wages, if she has bank accounts you may be able to attach those, if she has a house you may be able to place a lien on it. But NONE of that can happen until you get a judgment against her, and that can not even begin to happen until you file a suit against her.
In fact a suit often has the effect of putting their feet to the fire, realizing that you are serious. Where if there is any chance she is at fault, which in your case it sounds like it, you may get a rather quick settlement.
