Public Motors refuses to return my $2,000 down payment. Sean Brown with Public Motors contacted me at work about 2-3 weeks after I purchased a car, telling me they were not able to finance me so they had to CANCEL OUR CONTRACT.  He asked me to return the car - which I agreed to do at the end of my work day.  At 12:30 pm the same day a co-worker tells me my car was being towed away.  I went outside to find a tow truck driver (employed by Public Motors) getting ready to tow my car.  He explained that Public Motors put my car on a list for Repossession. I asked him to wait while I contact Sean Brown with Public Motors.  When I spoke with Sean Brown, he said his boss ordered the repossession.  Sean would not let me speak with his boss, only telling me they were repossessing my car.  I told him I didn't understand how my car was being repossessed when I agreed to return it by 5:30pm that evening.  I reminded Sean of their contract and told him I would be expecting my down payment to be returned to me.  He said they would not be returning my money however, if I had someone to co-sign for me I would be able to purchase another car.  That would be the only way they would return my downpayment.  I reminded him, again, of Public Motors Contract "Sellers Right to Cancel" Clause which states: "(b) Seller shall give you written notice (or in any other manner in which actual notice is given to you) within 10 days of the date this contract is signed if Seller elects to cancel. Upon receipt of such notice, you must immediately return the vehicle to Seller in the same condition as when sold, reasonable wear and tear excepted.  SELLER MUST GIVE BACK TO YOU ALL CONSIDEDRATION RECEIVED BY SELLER, INCLUDING TRADE-IN VEHICLE". I purchased it on Feb. 28, 2010. Sean Brown called me at work on 03/24/2010. I told him he had No Right to repossess the car because I was not late or in default of payment and that I agreed to return the vehicle that evening.  He became rude and angry and told me they were repossessing my car because I my license was not valid.  I told him when I purchased the car the salesman was fully aware that my license was expired. The salesman was insistant that he could get me insurance on the car for one month (which I paid $500.00 extra).  Sean Brown changed his story again and said they would not return my downpayment due to fraud, saying I gave them information that was not correct. I told responded to him saying, "if I gave you the wrong information, how then were you able to contact me at work?"  He ignored my statement and asked me to turn the keys over to the tow truck driver.  He said, "Whether or not you give the driver the keys, we will take the car and you will be liable for any damages done to the car".  I surrendered the keys to avoid any damages to the car.  The next day, I called Sean Brown again demanding that Public Motors return my downpayment.  Again, he refused. He said the car would be put up for auction and I would owe the difference of what they sold it to me.  It was a 1996 BMW which I found out they over charged me.  The Kelly Bluebook on that particular model and condition was only $7,000.  They sold it to me for $9,000 + finance charges the total came to $15,000. At one point when I was about to sign the contract, although I had already given the $2,000 down, I changed my mind and decided NOT to purchase the car because I didn't have a valid Drivers License. The salesman had me there until approx. 9:00pm (closing time) pretty much refusing to return my money trying very hard to convince me it was okay for me to drive the car away because I had insurance for 1 month. All I want is my downpayment back.  I have no job and no car and being a single mother of 3 children is very hard with no transportation.
