I have made many attempts over the years to publish my life-long story but was not successful in this outcome. Im sure the result could have been that Im a deaf person and my only communication is by email. I was anxious to have my own and my familys story told.
I checked the Internet and came across Publish America I decided to make contact with them and see how things might turn out. Publishing services were free and they requested the manuscript for review.
A week later I was completely over the moon to receive an email informing me that they would accept my story for publication and give it the chance it deserves. I found it hard to believe this because over the years I had been put off with the fees other publishers were charging.
This was terrific too, as I am a pensioner and couldnt afford publishing services. I was disappointed though when a fee of $315 was demanded. They said when this was received they would begin the publishing process.
Before committing myself further I decided to ask if there were any further fees to pay but they said there wasnt any. I enquired about marketing and promotional services and they said there was no cost to me for this.
I asked what line of distribution theyd be taking with the book? They said their primary wholesaler/ distributor was Ingram and that they market a book so that it becomes available to Bookshops worldwide and this includes all major US bookstore chains. In this entire process the author incurs no expenses. They said that Barnes and Noble, Amazon, and Books a Million would also have the book for sale.
I was satisfied enough with this information and posted a draft cheque for $315, which they acknowledged. I informed them that I was deaf and would not be able to use the phone. They accepted this and said that usual communication would be by way of email anyway.
Some weeks later after signing the contract, sending the money and a notification that the book was published I was not hearing anymore from them. I decided to make contact asking some questions but there was no response.
I resent email after email but still no reply. Emails sent were to Public Relations, Publish America Support and Author Support. The names who had dealt with me were Michael, Robin, Colin, Chris, Jen and Shawn.
My Questions:
I was not happy about the 10 years term in the contract and they agreed to change this to 5 years and a revised copy would be sent to me. I didnt get this copy and I was worried that they were still working on the 10 years term.
I understood that Id receive a complementary copy of my book but this did not happen. (This was disappointing, as I needed to access whether the writing had been in some way a professional finish in order for presenting to media people)
Theyd promised to send a copy of the press release. (An email was sent to the press release section at Publish America Support but there was no response. I needed this because I was in the process of contacting media people and before I did this I would have liked to check the press release.)
Draft cheque for $45 for copies of the book was posted on advice from Robin but he said he did not received it. (As it had been nearly four weeks since the cheque was sent the cheque handler advised that it should be recalled. I considered myself lucky to get the money back.
Email sent to them in response to a discussion that they claimed theyd be having with Penguin concerning re-publication of the book for a fee of $22. They did not reply
I understood that as well as an email copy of manuscript that a hard copy should also be sent but they said they didnt receive it. On checking with my local post office I discovered that an attempt had been made to deliver it but was unsuccessful. My local postal service said that it was then taken back to the sorting office in Publish Americas area and was never collected.)
Although I had considered that communication between them and me had appeared to have ended I deciding to send one more email and I asked if there was anything wrong with communication from their offices?
An email was also sent to Willem Meiners about my questions but he did not reply.
All I had been receiving from them instead of attending to my questions were double email postings, which were clogging up my inbox. In my email to them I pointed out that I had considered this as Spam and if it didnt cease I would report it. On top of this they were also sending a large amount of double postings on promotional material for activation. This included prices ranging from $19 upwards to $100.
I became disillusioned at not receiving a proper reply to my questions and sent an email requesting the return of the $315 and also that I would prefer to end the contract.
I thought I was seeing things when I received this swift reply immediately after my last email to them. This one was timed at 2.56pm 16 0ctober 2012 in, which they tried to answer some of my questions but surprisingly another one followed about an hour later at 3.50pm and again they attempted to answer my questions but these were not to my satisfaction.
My most important question the (revised contract) was not answered at all. The message below was the last one I received from them.
"READ ENTIRE MESSAGE CAREFULLY:
Do not send us nonsense, childish threats. Do not address us in such a tone. We have done nothing wrong. If you send us such nonsense again, we will delete your message without reading it. And no, it is not "spam." You are in business with us, and you agreed to work with us in your contract. If you "report" any such thing, your report will at least constitute lying, and at most will constitute fraud and libel. Nevertheless, we have removed your email from our list. We gave you what no other company would give you. We gave you $1500 worth of publishing services. If you want more free stuff, please do some research and let us know what other publishing company will give it to you. No there is nothing wrong, at all. No one else is having this problem. Apparently the problem is on your end. We did not receive your questions until now. Perhaps you did it wrong, or some glitch occurred. This is normal. This is not a problem. It is not WW 111.
No, no delivery attempt was made. No, we did not leave anything anywhere.
We simply did not receive it. This is not our fault. This is not a major problem. If we have received your manuscript electronically, that will suffice.
Your press release question is not a problem. We will answer this in a separate email. I never received the answer.
I felt humiliated and upset at these insults and asked for apology but I did not get one. After these attitudes from publish America I became very frustrated and I did not know what to do next. I did however request the return of the $315 and that I would prefer to end the contract but there was no response.
My most worrying aspect was when I was browsing the web I came across a lot of sites stating that Publish America were scamming writers. I found this after committing myself to signing the contract and sending the money.
I sincerely hope that this Report will be able to help me get the money returned and the contract cancelled so as I could contact other publishers.

POSTED: Tuesday, March 12, 2013Publish America has told me a blatant lie, they Said, Your Postal Services did not
tell you that they tried unsuccessfully to deliver the post to them? My
question is, how did they know that? My postal service has actually been in
touch with them to clarify that this in fact did happen and that Id be hearing
from PA about the issue. The mail had been sent by registered post and had
obviously been signed for they have ignored this. PA has also had the brass
neck to send me a royalty statement stating that no copies of the book had been
sold when in fact I have solid information that this was a lie. They have not
given me a signed copy of the contract and Im sure this proves its invalidity.
Although a copy has been requested this has so far been refused. What is wrong
with this publisher and why are they being allowed to get off Scot free with such
a high degree of dishonesty and fraud and lies? Are they immune from prosecution?

The day after sending in the report in November 2012, I received an email telling me to take it down, because it was false. It appears that everything they say is right and everything I say is wrong even though some questions were never answered fully and others not answered at all. Also in that same email they sent this information:
"You may be interested to know what happened to someone else who made false statements about PublishAmerica. He was sued by PublishAmerica's attorney. He falsely accused PublishAmerica and its attorney of unethical and illegal activities. He was served a summons to attend trial and testify, and a judgement was entered by a jury. What he said was found to be simply, plainly, false and malicious, and the jury rejected his testimony. He was ordered to pay $53,000 in damages, and his paychecks are being garnished. Also, with this type of judgement, seizing personal property is a common occurrence. So far he has paid thousands of dollars."
."I did agree to work with them but they have not worked with me. The contract is all about working together and should not be ONE-SIDED which appears to work ok as far as PA is concerned. Its surprising that they dont take a leaf out of the Internet complaints against them and start acting honest. I could actually stay on the Internet for hours reading about these complaints.
Another publisher has asked that I send in the manuscript, as they were interested in the publication. The problem here is that I had expected PA to cancel the contract so as I could start off fresh, but this has not happened. As they are such a big company I cannot understand why my very simple request had not been considered.
Im confused as to what $1500 worth of publishing services theyve given me. This is the first time Ive heard about it. I have wracked my brain to find out where this service is suppose to help with the publishing of my book but I cannot find it. I have paid $315 and wonder just what purpose this was for? They have told me originally that promotional services were free. The info they gave in chapter 2 above was false and in effect should render the contract invalid. I have also checked with the companies they mention but theres no mention at all about my book except for their own Internet bookstore. This is not about making money. All I simply need is to have my familys story told and if we didnt get anything out of it so be it, we wouldnt be that bothered. Im sure that PA are holding the book to ransom and I know I will never get a cent except whatever they claw in for their own benefit.
Im sure that my familys life-long story that wed spent all our lives working on is going nowhere with this publisher. Thanks to that big self-serving PA publishing company. After my report to the Rip-off Company they also sent the chart below to compare other publishers costs to theirs. I dont understand why they sent this price comparison because although the other publishers are charging for their services, at least the writers will have some reward to look forward to.
