My son Carl, was arrested May 21, 2007, because Rent-A Center said, he stoled property, facing a Felony charge.
Carl, paid off a bedroom suite, that was in my name over a year ago, Rent-a Center, called me one afternoon, telling that I could pay off this bedroom suite, If I pay $74.00 that day, which was a year ago. I got my son and his friend to pay it off, and Carl descide to get a mattress, that same day. Oh, the guy that was working could not print off the pay off paper until the manager showed up the next day, which was fine, I have purchase alot of stuff from them in the past. I thought I new them really well, to trust them.

In the meantime, Carl got a mattress and Jon the guy who was helping him, was going to give Carl a ride home with the mattress, Carl and I told them we wanted to make sure they new carl was moving to a different county and that was why we were paying off the bed, they new the new address.

Well Carl moves, two weeks later they are calling for a payment on the bedroom suite and the mattress, So I try to take to the manager, and he refused to talk to me, after several attempts he finally talk to me hateful, I asked him how Carl owed for the bedroom suite when I paid that off, and how did they take it out of my name and put it into his name.

Anyway, to find out threw my son, that the manager wife and my son-in-law were having affair, and the manger was taken out on Carl. I told this manager not to hold me responsiable for my son-in-law. Rent-a Center did not want to work out anything, So I told them here his address, come pick the stuff up, because he could not afford to pay off the bed again.

After, a Year I assumed they found out the bed was paid, and that Carl just owed 200.00 for the mattress.
Wrong, the sheriff came to my house, wanting to arrest Carl. They called him at work, which caused him to miss time, I had to take him to the Harrisonburg Police department, so they could arrest him, Rent-Center said he stoled the property, Do you know what it like having you son put into handcuff? I do not know a manger could take personal business out on customer, and make it seem like they up and left the state of Va. My son has to go to court about this June 4th 2007

update:

We went to a Lawyer and everything has turned out the way we wanted to. The only thing my son is doing is returning the mattress. No aggreement was signed with his name on it. The District manager just was holding a grudge against my son.

Responsibility

What your son would be considered in the rent-to-own industry would be a "skip". What a "skip" is, is someone who rents merchandise and does not satisfy the terms of the agreement or return the merchandise. It doesn't matter whether the amount owing was $1 or $1000.

In most states there are different levels of criminal offenses for failure to return rented or leased merchandise ranging from a Misdemeanor to a Class B Felony. Most "skips" get away with the merchandise without any legal trouble, but it is almost better to return what is NOT yours to avoid possible scenarios like yours.

As far as the bedrrom set that you were renting that they transferred into your son's name. It is a possibility that the management in the store you were dealing with were dishonest. The mistake you made was trusting someone that you didn't know very well. Without a receipt showing the bedroom set was paid in full you have nothing to stand on. You have your word against theirs.

ALWAYS GET A RECEIPT ANYTIME YOU GIVE A BUSINESS OF ANY KIND A MONETARY PAYMENT YOU NEVER KNOW WHEN YOU MIGHT WISH YOU HAD IT.

The only way out of this for your son is if he never signed a rental agreement. Other than that he is 100% responsible for the bad decisions he made.

Excuse me Judy, but your typing is a little hard to follow. Your saying that your bedroom set was paid off and your son then decided to (rent? purchase?) a new mattress.

"Oh, the guy that was working could not print off the pay off paper until the manager showed up the next day." Was this "pay off paper" for your bedroom set or the mattress that was rented? purchased?

Then you mentioned, "After, a Year I assumed they found out the bed was paid, and that Carl just owed 200.00 for the mattress." So does this mean that Carl rented the mattress? If so, couldn't he have paid off within a year, especially when he only owed $200. Maybe instead of renting-to-own furniture, you both should try to save money until you have enough to purchase what you need/want in cash. You paid a lot more with interest added than if you had just saved money and purchased from a regular/reputable/specialty furniture store.
