Resurgent Capital Services, LP called me and sent me a bill for $205.97, then increased with interest to $223.53 over a week's period. I had sent them a letter disputing such debt, but they not only ignored it, and sent me another letter with a supposed "validation of debt" and an increased amount. When I called them by phone and asked them about what I supposedly purchased six years ago from JC Penny, they are unable to tell me. Their letter reads as follows: "This account has been placed with Resurgent Capital Services LP.

Enclosed please find a validation of debt that verifies the debt. If you have any further questions, please contact one of our Customer Service Representatives toll-free at 1-866-464-1187." They also had translated some of the information into Spanish, which makes me think they are abusing people who might not understand the law and the English language.

I'm seeking advice from custumer legal services here in Olympia, WA; I'm aware this might be a lenghty process, but I'm willing to stand by my rights. These people should be brought to court. Their threats are disturbing my well being, and ability to concentrate in my daily life, and work. There are health related problems associated with the stress they are causing, and no one should be subjected to such abuse!

First, it is really sad that Bud Hibbs passed away in 2012.   This is the type of thing he taught us well.  This ones for you Bud!! 

If you haven't already started a"file" and a call log.  DO IT NOW.  This might be able to win you $$ in court - especially since they are notorious for unethical and illegal actions.   You can set your log up anyway you wish but time, date call received, robo call or human, the number called from and the message.   do not answer the phone.  let it go to service ....

Is the debt really yours - keeping in mind they have tacked on thousands depending upon the length of time they have been trying to collect.  Has the statutes of limitations runs out?  Credit card debt is an open line of credit and each state has a maximum time limit for them to collect.  Be careful what you write (the less the better) and ALWAYS deny the debt until THEY can prove it under law - not their imaginations.   If anything you say or write opens the door to the slightest you MIGHT be agreeing to the debt your SOL starts over again.  

You need to send the bloodsuckers a request for validation that complies with all the usual consumer right laws.   If you don't have a USPS certified receipt <or> the return receipt card go to the post office FIRST and obtain them.   TEll them you dispute the debt and to send validation.   remember validation according to the government is very strict.   They cannot send you a one line statement saying "we looked at it and you owe it". 

ON the letter make a subject line CERTIFIED LETTER NUMBER: and put the certified number on the LETTER ITSELF.  Why?  Because they are going to claim they never got a letter, etc. and when your attorney produces the letter you wrote with the certified number on it along with the paid certified form AND the return receipt (little green card), they have just lost creditbility.  not that they have credibility in the first place ..... 


The next thing I would NOT do is actually sign my name.  Why?  Some collection agencies have a really nasty habit of forging your signature on documents.  Just type your name.   Also when completeing the return receipt card, I would recommend printing or typing their address and or address so there is no hint of your handwriting.

go look at some of the letters available keeping in mind the above.    Summation:  don't talk to them, send all communications certified return receipt requested, put cert number on letter, do not SIGN your letter, make them prove you owe the debt, keep a log of all activity (calls, letters, when certs are delivered)

I work for this company and the debt validation is a time period. You have 30 days to despute this debt in writing, if we do not get than in 30 days we will assume the debt is valid. We buy the debt from the original account holder in your case JC Pennys. We do not have specific information on what was purchased. The only info we get is the info that is given to us via the original account holder. We do NOT abuse our customers in any way. We opperate within the limits of the law and are regualted by the govt and are members of the BBB. If you sent us a letter desputing the debt we would not and could not have just 'ignored' it due to federal law. We are required to send you all info if this debt is in question. I would call and ask for the address to send the request of debt validation to and they will give it to you. As I read on it seems you were already sent validation of the debt. You dont make any mention of what the debt validation was all you talk about is the letter that came with it. Since you did recieve info on the debt we did not just ignore your letter. We sent you PROOF that the debt is valid. If you are still not convinced then I would call and do a verbal dispute or ask to talk to a supervisor. Good luck and i hope all works out well for you.

This company is known for sending people very poor ideas for "debt validation." As many of these validations do not conform to federal law under the FDCPA, they are merely laughable at. lol.

This will serve as your legal notice under federal law of the Fair Debt Collection Practices Act of Congress (FDCPA), to cease ALL communication with me in reference to the above account.

If you don't follow this notice, I will be forced to file a formal complaint against you with the United States government agency, the Federal Trade Commission, who is responsible for enforcement, the state Attorny General's Office and the American Collector's Association who monitors collection agencies for non-compliance with this federal law.
