I found RTO Capital online while searching for a rent to own house in Southern California for my family and I.  When I came across the website I searched the inventory and didn't find anything worth while.  That is when I put a phone call into Larry Gonzales to discuss the rent to own process and how it works.

He discussed the process with me and told me to keep checking on his website for properties and if I find one to contact him to see it.  The inventory wasnt really updated so that is when I saw his "Custom Home Finder Program" that he advertises on his website.... BEWARE!!!!!!!

So I contacted him to discuss how this works and told him my situation how I only had 30 days to find a house as I had to move out of my current house.  He said that the program works by me giving him a deposit of $2500 and that signs me up for the program and when he finds me a house that money plus an additional $5000 would go towards the down payment of the home once I purchase.  If he doesnt find me a house then the deposit is completely refundable.  He told me that he usually requires 90 days but would try to do it in 30 days for me and we set up an appointment to meet at Starbucks.

At the meeting he spoke extremely confidently how his program will find me a house and how he gets 100 phone calls a day from people wanting to use his service.  After talking for some time about my situation and how I only had 30 days to find a house he again said he would try to get it done in 30 instead of 90 days.

After the 1st week of absolutely nothing from him except short cut off text messages of how he would have something shortly, I realized that I shouldn't rely on him finding me anything in 30 days.  To be completely honest his communication almost completely came to a stop after I gave him the $2500 deposit. 

So 30 days past and I contacted him to get my money back becuase he did absolutely nothing for me, not even one possible house to look at.  At that time he said that I signed a 90 contract and if I cancel now I would lose my deposit.  I then reminded him that we had a 30 day agreement and pulled up my contract of which he only had me sign the 1st page with no mention of 90 days.  There were other pages with the contract that had a place for signatures that he did not have me sign and that is the only place that mentioned 90 days.  I never agreed or signed a 90 contract.

At this point I told him that I am not going to cancel because that wouldn't make sense for me to just throw my $2500 away.  And that was the last contact I had from him until the 90 days was up.  For 2 straight months I emailed, texted and left voice mails asking if he had a house for me and that I was actually still needing a place to live and was very anxious to see if he could find me something still.  NOTHING.

90 days came and went and I emailed him and texted him asking for my deposit back becuase even after this long he still did not find me anything.  I then get some BS email from stating I cancelled and forfieted my deposit.  I then asked him why I would contact him for 2 months straight and not get any response from him.  I asked him that question over and over again and he has absolutely no answer and just saying I cancelled. 

He is an absolute scam artist and manipulates his so called contract so it benefits no one but himself.    He knows I didnt cancel anything and still refuses to give my deposit back.  After searching online I have found multiple other people that he has scammed as well.  I will be taking him to small claims court and urge anyone else to do the same and will also be contacting a lawyer for a class action lawsuit along with the DA for criminal charges to be filed.  People like this are a waste of skin and should not get away with taking advantage of other peoples unfortunate situations.
