Let it be known that I was threatened by this company by way of monitary means. They have tried to file a lien but in texas as part of the laws with a HOA is is illegal and also the laws states that attorney fees can not be applied when an HOA is involved either. I have sent thier so-called attoerney and them certified mail and according to the laws of Texas requested a hearing with the HOA. I have yet to recieve any letter from the HOA in any manner. Texas law states the HOA must have its own address and mail box not associated with any other business and it must be in the area that is of or cloase to the HOA.
I have tried so hard to reach the so-called HOA but Real Manage keeps blocking this for fear they will lose the extortion methods of collecting money from people who do not know what is in the law. The attorney will be dealt with through means I have planned out and grounds thast are very stiff. Number one if any person has information on another person with out having it in writting then he or she has broken the law. And for an HOA to give( so -called ) power to real manage is illegal. The rules for HOA are simple, the fees are raised to support the local area and not line some body elses pocket nor an attoneys. .
The worse part is that they think they are right but I have sherrif reports and case filed for threats they made against my home and my finacial well being. This is highly illegal. I have sent them certified letter and numerous email charging them with invasion of privacy and they dont care, but its thier call i will not waste any of my money on them and also they owe me not less than 375.00 for time i had to take off work to send them a letter. By the way it is FORGERY FOR ANOTHER PERSON OR COMPANY TO CASH A CHECK THATS STATES ELM CREEK HOA only on it. This charge will be added to a counter suit when it comes.
Did any one know that they had an attoreny help thme creat a title compny which they do all the closing in house so your bank does not see the papers till after its done and hope you dont know or catch them in it. Big problem I caught them with thier hand in the cookie jar // my contract is with elm creek HOA only and not real manage. So i guess this means they will bring a unlawfull suit which i will WIN and i do have the skill and means to do so. As far as paying a property manage company in texas YOU DO NOT HAVE TO PAY.
THIS FALLS UNDER THE UNFAIR DEBT COLLECTION PRACTICES ACT. They must proove you knowningly signed a secondary contract for them to charge you. But as my contract reads excluding the illegal papers that lawyer sent me wich was not at closing. ( they were after the fact) that is grounds for FRAUD, BY THE WAY he will not and cannot file bankruptcy on FRAUD. The law forbids it, been there and won in that court already. As for them I am not scared cause there are a few deputies in the area and they do see what I mean.
