In october of 2008 I signed a contract with Realty Trade to list my time share for sale and for rent. In November I received one email stating that a certain party was interested in the time share. I emailed that individual and never received a response. In April of 2009 I sent a letter to Realty Trade requesting a refund of the money I paid because I never received an offer on the property. I was told that the email (that no one responded to) was the offer and the only thing they would do is extend my contract for six mionths, an dif I didn'tr receive an offer after that, the money would be refunded. I received notice in May 2009 that a Carl Ramsey was interested in the property. Co-incidently , that same name came up in another complaint from 7 months earlier. I emailed Mr Carl Ramsey. Initially I received no response. After telling Realty Trade I received no response, suddenly I received an email from Carl Ramsey, saying he would meet with his lawyer and let me know. Then a week later another email saying he was advised not to purchase a time share. So I still haven't received an offer. In the meantime, Irealized after loking at the listing on Realty Trade web site that the property was never listed for rent. I paid $595 extra to have it listed for rent. I sent an email to customer service requesting a refund because they never listed it for rent. They responded that someone would call me. No one has called. I sent another letter requesting a refund. I have had no response. My next step is to file a small claims lawsuit. I will ask for the max of $5000, for not refunding my money. Perhaps a class action lawsuit should be initiated.

Lawsuit update

I filed a lawsuit against Virtual Group Inc dba RealtyTrade in Superior Court in CA because they did not get me a reasonable offer in six months and refused to refund my money as was promised in the contract. Virtual Group Inc has challenged the venue, citing a CA Civil Procedure and the venue clause in the contract.


The CA civil procedure they cited does not apply in this case. CA Civil code 395 (b) states that in the case of a contract for personal services, the proper venue is the county where the contract was signed, so their first argumnet is out the window. As for the venue clause in the contract, if I can show the court that Virtual Group Inc dba RealtyTrade entered into these contracts with the intent to defraud the consumer, then any contract they have is invalid and any clause in it is invalid. 


I intend to present to the court the report from the Florida BBB showing the number of complaints against Realty Trade for the same complaint as mine, which establishes a pattern of intent. I need as many notarized statements as possible from any of you who have been victimizedas I have, in order to further prove to the court that Realty Trade has a pattern of defrauding the consumer. Since you cannot send it to me through this web site, you can send it directly to the court. The hearing is on 9/9/09.

Realty Trade No Refund Update

After I filed a complaint with the Florida BBB, I received a call from Mike Holland. He told me that they had the verbiage in the contract to protect themselves from people who use their company to find a buyer, and then after they find a buyer, try to get their money back. That is pure BS. Has anyone ever found a buyer using Realty Trade? Do a search on the internet for timeshare resales and see if the name Realty Trade comes up. It doesn"t. They say they are marketing your property, but has anyone ever seen their property marketed? How is it being marketed? They show no proof, only lip service. Anyway, I told Mike Holland that all I want is my money back. If I don't get it back, I will sue in small claims court. He told me I have to come to Florida to sue. Well guess what? No I don't. The rules in California are that you can sue where the contract was signed. After I talked to Mike Holland, he sent a response to the complaint at the BBB saying they had successfully marketed the property and that I had received two offers, and I was trying to get something for nothing. He has it backwards. They are getting our money for doing nothing. I spoke to a lawyer and he told me that half an offer is not an offer. If no one responded to you, the offer is not consummated. Anyway, I filed a small claims lawsuit on July 28 for $5000. I had the court serve the documents by certified mail. Of course, Realty Trade didn't sign for the mail, because the return receipt didn't come back after two weeks. I am sending the documents to the Orange County Sheriff and have them served in person. It only costs $40. I will let you know how it turns out.
