On Friday March 6th, 2009, I informed Regions bank that a company had processed a charge through their bank that I did not authorize. I explained that the company (company name: allied semiconductor, of which I'll also be filing a complaint shortly) processed another's order on my card, by accident. The reason I knew this is that the morning of the 6th, I'd discovered that two checks bounced which should not have bounced, due to my having enough funds to cover what I'd purchased.

I contacted my bank and the branch manager named Viviana Gomez 813-805-7338, about the issue. She said, calm down, don't worry, all funds will be returned to you, don't lose sleep over this, it will be okay. I said, great, thank you. The next day I went to the bank and filled out the appropriate paperwork. I then calmed as I was assured this would not cost me.

The next day, two more checks were bounced, but I did not worry as I was informed that all overdraft fee's would be returned. On Wed morning, I discovered that the charge for the error from Allied Semiconductor was returned to my account, but not the NSF charges. I called the bank. Now Miss Gomez stated, We're not going to refund your money, you need to get it from the company that made the error. This company has an F rating with the BBB. When I told them that I wanted my money or would report them to the BBB, they laughed and hung up the phone. Regions bank will not honor their word, and in my opinion, have stolen my funds. They refuse to return it even after knowing that this was beyond my control, and not my fault. It seems to me that stealing is still against the law, and they have essentially stolen my money. Everyone who made the errors seem to NOT BE RESPONSIBLE, and will not pay. I sure did, and I can't afford to just give money away to thieves.

This is very wrong and should not be allowed, but somehow, they get away with stealing. So the original charge was $161.00, the NSF fees were $140.00, and since I got the 161.00 back, we essentially got a total of $11.00 of our $161.00 back for a mistake that was not even our fault. Thank you!

It is sad, isn't it?

Back in the old days, when customer service was important to the banks, the rule was as long as it is not your fault, the bank would refund the OD fees. Now, the rule is they will only refund the OD fees if it was a banking error that caused the fees. Allied Semiconductor made the error, therefore the bank does not have to refund the fees (but wait, read below) This is the rule of almost all banks, not just Regions. And, yes, it's one of those ridiculous rules to help them steal your money.

To those of you who are going to inform me that it is not a ridiculous rule, sure it is. Anyone with any common sense would agree that if a company took money out of your account in error, and that caused OD fees, the bank should refund the OD fees. I know, you're going to say, "But it's not the bank's fault". That's just horseshit. It sure is the bank's fault. They paid Allied with no authorization from you.

If Allied was able to take money out of your account with no authorization, and your bank allowed it (bank error), why can't your bank just take your OD fees right out of Allied Semiconductor's account with no authorization if they believe it's Allied's responsibility to pay those fees?

All of this points to the fault of the company that charged your card twice, and not the fault of the bank. The bank received authorization to charge your account and this authorization would have come from you. Now, you obviously didn't ask for the second charge to be authorized, yet the bank would not have known this unless you protested.

You need to go after the company that did this to you - go after them legally and don't stop until thy cover your OD charges, or at least they come to some amicable agreement with you. Best of luck.

Regions Not Responsible

The bottom line here is that region is not responsible for the charge coming through incorrectly. The company that sent it through is responsible and Regions is correct in not refunding your money. The company that sent the charge through to your account is responsible and they need to reimburse you for those charges. I would certainly threaten legal action to this company in writing with a return receipt that you know they received it. I would also reference the law firm you are willing to use to fight them on this charge. Regions just processed this transaction or transactions as if it was authorized , until of course you told them it wasn't. The other thing you could do it file fraud charges against this 3rd party company and close out your account and open another account. This would also let regions know that you believe it is fraud as they have your account number and should not have it. Regions may than waive the fees as it is due to fraud. However, if you don't take this measure it is not regions fault and nor yours it is the company who processed the charges incorrectly on your account.
