I rented a window unit from RAC and it has been a nightmare. They have called before it was due and called my job after my boss told them not to, over 35 times. They have sent me a certifeid letter and threatend that I would be arrested. They have broke numerous fair debt collection laws, as far as I know. Can I be arrested for not paying them the rest of the balance? I have paid almost $400.00 already.

people are so silly have you ever rented an apartment, did you get all mad when you moved out because all the money you paid was gone.


the fact of the matters is and you might not like this but you are a dead beat looking for any reason to stop paying for something.

i have heard your crap somany times maybe not from you but i bet i could finish have of your sentence for you.

i know iknow i am mean but you know deep down just like most of the peolpe on here complainintg how mean the big bad rac is
ripping them.

of course this allows you to completeing ignore any sence of responseabily for you actions or choice get real get a life and do what you promised to do in the beginning of the agreement

you know it is amazing the customers that are always late are the one who always complain wonder if there is something to that hummmm i wonder or then agian maybe i am just wrong

but i dont think so dead beat

I hate people that can't pay thier bills and how they love to blame R.A.C. employees for doing thier job. If you don't understand I'll explain an acct. managers job. His job is to train customers to come in on time if they don't he isn't doing his/her job so they get written up for it. and after a while they will be terminated if their people don't pay. Thats why they are so persistant in getting someone in to pay or get the merchandise. Because if they don't get a certain percentage of thier customers in to pay they could lose thier job. So it's either call you three times a day and show up at your house to get you to come in and pay or lose thier job. What would you do?

Save for it, Don't make payments

If you can afford to rent a window unit and pay $400, yet not own it, how about saving the money you would have paid them. Then you could have gone to Home Depot or WalMart and purchased a window unit for less money and owned it. I believe you could get a top of the line air conditioner for $400.

This concept applies to most of the rent to own goods that these rent to own chains offer.

Best to give it back if you can't pay.

Give the unit back if you can't make the payments. Otherwise you will owe more and more each week, and eventually may be in legal trouble. State laws vary on whether you could be arrested or not. Even though you may eventually be vindicated because they are abusing the process left and right, it isn't worth it just to stay cool for a couple more months.

If you can make the payments but choose not to because you realize the deal is a rip-off, it's really too late. You should have realized that before you started. In order to decide whether it's worth making any more payments, find out how much (total) more you'd need to pay to get ownership of the unit. Compare that to the price to buy a similar unit elsewhere. If keeping the RAC unit will cost less, pay it off. If it is more, you should give it back and be done with this deal. Save up your money and buy a new or used one outright.

The money you have already paid is *not* a factor in this decision. That money is gone regardless, and clearly it was a big mistake. Don't dwell on it. Evaluate the options you have *now* and decide what is best for the future.

YES, YOU CAN BE ARRESTED for theft by conversion

What you entered into is a RENTAL agreement with rental payments being applied towards ownership. You do not have the same rights as you would in a retail finance contract. You can be arrested for theft by conversion, which is converting someone else's property to your own use without paying for it or permission of the owner. When you stopped paying the rental fees, RAC ceased to give you permission to use their property.

I suggest that if you can't pay for it, you need to return their merchandise before you end up in deep trouble, just as a former next-door-neighbor of mine did. He got a year of county jail time for theft by conversion (felony). I personally don't think a window unit or anything else would be worth a criminal record and/or loss of freedom.
