I received from Resurgent Capital Services a bill for collecton of $356.34, for Creditor LVNV Funding, LLC. Never heard of this bill or the company.

I wrote a letter to the former collection agent, Northland Group and informed them that I did not owe the debt.

I intend to follow up by writing a letter to the State's Attorney of South Carolina, Minnesota and Illinois - these companies are all owned by the same person. I will do everything in my power to put a stop to this kind of harrassment.

Another question about the cease communication letter....

Steve, you seem to know a lot about the practices of these collectors. ARS National was calling me and they just sold the debt to Northland. Problem is, same name as me, wrong addresss and SS #, so its not me.

I'm concerned if I send a cease communications letter, they will get my address and start sending me the bill. I don't want to give them any more info about ME than I have to, but I DO want them to stop calling me. Do I have to put my return address on a registered letter to them?

Jessica, just do it like this

Jessica,

There is no standard format, although you can go to budhibbs and get one for free. Be sure NOT to ever sign anything you send a debt collector, just print. Send it like this:
By certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important as it proves what you sent.

In this letter make it short and sweet.

Under the provisions of the FDCPA I am requesting that you cease all contact with me. The number you have been calling is xxxxxxx, and my name and address you have been contacting isXXXXX.

All contact will cease immediately upon receipt of this letter or I will take legal action against you as provided for under the FDCPA.

Print your name here.

Be sure to date the letter.

How to I go about getting a CEASE COMMUNICATION letter? Is this just something I type up or is it a more legal form I need to obtain? I did send a letter after our second letter from them telling them basically what I typed on here, that we do not have any specific debt owed in over 4 years and that i wanted them to clarify what it was. I have not heared back except for the 2 calls (Which I did call them back and have not heard back, but I will be sure not to communicate via phone any more as you suggest).

If you could get me the info about the CEASE COMMUNICATION letter I would really appreciate it! Thank you again for ALL your help!

Jessica, this is easy

Jessica,

The first thing you want to do is to stay off the phone! NEVER call or speak to ANY debt collector on the phone! NEVER!! It will never do anything positive for you and will in most cases make things worse.

Everything must be done in writing.

Simply send a CEASE COMMUNICATION letter to them by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important as it proves what you sent.

Now, when they violate this legal request, you sue them for up to $1000 in punitive damages plus costs.

In the future, NEVER respond to ANYTHING a collection agency sends you in the mail. NEVER!

The only thing you never ignore is the summons. However very few actually sue. The odds are in your favor.

I'm glad you got them off your back, but letting them hound you for 6 years is ridiculous!

FYI.. The only government agency with ANY jurisdiction over debt collectors is the FTC, under the provisions of the FDCPA.

Those agencies you wrote too sent letters on your behalf as a courtesy, but Resurgent/LVNV could have told them to jump in a lake and there would have been nothing they could do about it.

You REALLY need to GET PAID for all of your time and expense in dealing with these lowlife. You need to sue. That is victory! When you get a collection agency to pay YOU! that is something to brag about.

Another FYI. As per the exact wording of the FDCPA, the letter you write is a CEASE COMMUNICATIONS request. No law gives you the right to demand a "cease and desist". None. proper wording is essential.

Also, they will just send this to another one of their affiliates or will resell it and you will start all over again.

This is why you just send the CEASE COMMUNICATIONS request by certified mail/return reciept requested and wait for them to violate it. then you sue them and get paid. Doesn't take 6 years.

I stop collection agencies in 6 days!

In the future, read some of the other threads on collection agencies and follow the specifics I have laid out. I have never lost once, and the most time I ever spent in a battle was less than 60 days. And I got paid.

I am having the same problem

I had this company contact my husband out of the blue. We recieved a letter approximatly a month ago. It gives no clear information as to what the debt is. Me and my husband have been together for 4 years and no debt has been accrude in his name. I at first though this was an old debt that finally caught up, but why after over 4 years? I write the company asking them to clarify the debt. They sent another notice, sma e as before, I wrote them again. They the called. They sound SOP unprofesisonal on the phone. They left me a mnessage, so hard to understand, she sounds like she is in a room full of people. On there second call to us I was finally able to understand the phone number. I called it back, got the ladies voicemail and it is so completly un professional. While she is leaving her greeting she starts stumbling over her message, she starts laughing and talking to someone else in the room and then tried to leave her greeting again. I left a message asking them to call or send us a letter giving more details about the debt, and I even made a comment about how "unprofesional" her message is.

Anyways, I started doing some research today and see other people have complaints about this company. What can I do to get them off our backs? I live in California. Thanks for any help!

I just received a note from the South Carolina Department of Consumer Affairs - Resurgent has backed down. Resurgent was contacted by the SC Department of Consumer Affairs and I can only guess that they put some heat on the company. I wish I had a scanner so I could show the letter - such a relief that I will never be hearing from this company ever again.

My letter of cease and desist must have gotten through to this bunch of low lifes. They are the scum of the earth. Preying on people's conscience to do the right thing. I just wanted anyone who has any dealings with the companies involved to fight them to the end. Just like I did. They have hounded me for 6 years. But I am like a bull dog and wouldn't give up.

Don't any of you either. Bury them. If you need any assistance just e-mail me and I have addresses where to send the mail. I have gone all the way to the Governer of the States that these companies are located in.
