Resurgent Capital Services - Plains Commerce Bank Absolute RIPOFF!! Today I received a letter from this alleged company attempting to get me to call them at the toll-free number to authorize a credit card to pay off a debt I've never incurred! Sioux Falls South Dakota

SCAM...SCAM...SCAM This company is trying to get me to call its toll-free number to authorize a credit card through Plains Commerce Bank in Sious Falls, SD to allegedly pay off a debt I never incurred! The "Disclaimer" states that even if I don't owe this debt, authorizing this "credit card" will "transfer the balance" and, as such, legally obligate me to pay the balance!


These scammers apparently are trying to get this bank to give me a credit card and immediately steal all of my available credit.

I'm filing a complaint with the FTC ASAP!

You are absolutely correct. This is a common scam, and it usually involves a very old debt that is either past SOL and/or cannot be documented. They try to get you to do this so the debt gets legally re-affirmed and the SOL reset.

Lisa, your advice is somewhat flawed. here's why.

First of all the Attorney General is not there to settle individual complaints. That is not their role or jurisdiction. The purpose of the AG's office is to provide legal advice to other agencies within the state government and to oversee the legal aspects of offices like the consumer protection division, etc. They respond only as a couurtesy to you, and really have no legal authority to make anyone do anything.

As far as getting items removed through the dispute process from your credit reports, this is easy to do if done properly. The FCRA gives you the right to be provided any communications used id the processing of your dispute used in the verification process. However, you must clearly specify this to them in writing. DEMAND to see what was used to verify the debt.

Never do anything on the phone or online with credit bureaus or creditors. Always do everything in writing and by certified mail, return reciept requested. be sure to put the certified# on the letter itself and keep a copy for your records.

The only authority for debt collection issues lies with the FTC under the FDCPA. And, there is no individual enforcement. Your complaints are for statistical purposes only and after a certain number of complaints, an enforcement action may be taken.

The ONLY way to enforce your rights under the FDCPA is to file a lawsuit. That's it.

Interesting Your Resurgent Capital Services is located in South Dakota and mine was listed as South Carolina.

You have filed a complaint with the FTC but from my experience they will do nothing. By now the problem has been reported to the 3 major credit bureaus and your FICO score is trashed. If you call the credit bureaus they will not remove this item from your credit report. The only person that can do that is Resurgent.

If you pay the so-called debt you have now admitted you are a deadbeat and your credit report will still suffer. Do not pay them a dime.

The only way to resolve this situation is to contact the Attorney General in the state that this company is operating and file a complaint. It will take about 45 days but the Attorney General will contact Resurgent and force them to comply with the law. The law being that they must show you the evidence of this so called debt. Resurgent buys these unverified debts for pennies on the dollar and does not give a rat's butt if they are valid. Therefore they will have no real documentation on the debt and will be forced to back down.

Go directly to the Attorney General. They will help you.
