I live in one of the units owned by "Bob" Gomez for over 2 years. During my stay there Mr. Gomez would constantly be at the property doing work, asking to enter the unit (without 24hr notice), etc. When i decided to leave i gave "Bob" my 30 day notice. I cleaned up my apartment and did the walk through 5 days ahead of schedule but still paid for the full month. I left the place spotless. During the walk through "Bob" said "well, everything looks good. I'm sorry to see you go". We said our good bye and my girlfriend and i left.


I waited  over the 21 days stated in California law for the return of my deposit or a letter with an itemized statement explaining why my $1,200.00 has not been returned. But i didn't even get a call. So i called him, i asked what was going on with my deposit, he stated " well, the damage to the apartment was well over what the deposit covered. About $700.00 worth but don't worry about I'm not coming after you for it." Like he was doing me the favor. If there was $1,900.00 dollars worth of damaged I'm pretty sure he would have said something in the walk through or if someone cost me an additional $700.00 i sure would come after them. But I digress.


I went to the San Pedro Court House and filed a small claims case against him for my deposit. CASE# 09S01075  http://www.lasuperiorcourt.org/civilcasesummarynet/ui/?CT=SM . During the court trial he lied the who time, he stated that I "didn't give 30 days notice" that I "didn't do a walk through". He would also show picture of other peoples apartment and the ones that were of mine showed no damage and the reason for this he said "well, i fixed this before I took the picture". He also stated "it cost me $600.00 to fix a hole he was and it took me 8 hrs" this was one of the many crazy things he would state. He also brought in an itemized statement that he made himself with his own company header (RDG Construction). This company does not have a license to do any work you can look it up, lic#595174 https://www2.cslb.ca.gov/OnlineServices/CheckLicenseII/CheckLicense.aspx . His statement looked like he typed it the day before the courtcase was to be heard.


At the end of the trial the Judge ruled in my favor for my deposit to be returned to me. After the The judge read the ruling Bob Had a few choice words for him and shout to me "I'll see you at the appeal!"


The appeal came and we went through the whole trial again. This time he had brushed up on his lies but it didn't help. He lost the appeal and in addition the Judge awarded me $500.00 more due to "Bob" acting in bad faith.  This resulted in an angry phone call from Robert D Gomez "Bob" stating that i "am not going to see a dime".
