Robert W Hyland III Ordered Tivo unit thru ebay and then returned a different unit to me claiming I sent him a defective Tivo unit. I had marked the unit I sent him on the inside & outside before shippinig it to him, unknown to him & to prevent this type of fraud. Tulsa, Oklahoma

A buyer on ebay purchased an unused Tivo unit from me and paid through paypal. Prior to sending the buyer the unit I had marked it with an invisible ink that is only visible under ultraviolet light. I did this as a safety precaution because of the huge amount of fraud of this type. After he received the unit he left feedback on ebay. His exact statement, "Extremely satisfied." Then 10 days later he filed a complaint through ebay claiming the unit was defective and requested his money back. He was advised before purchasing the unit that all sales were final. In short, ebay decided in favor of the buyer and gave him his money back through my account which is listed on ebay as a condition of ebay's policy. Before he filed the complaint, the buyer called me and requested that I pay him $15 for the remote control which was missing. I mailed him a postal money order which I still have the receipt to.
Ebay has now given me a bad rating and suspended my account all with just the buyer's claim. The buyer was advised by ebay to send me the Tivo unit back. When I received the unit I immediately put it under an ultraviolet light to see if the markings were on it which would verify it was the original. They were not. I then opened the unit and repeated the same procedure, because I had marked it inside as well as outside with invisible ink that is only visible under ultraviolet light. Again there were no markings of mine, proving to me that the buyer had switched the tops of the units and given me his broken unit and kept the one that I sent him which was never used because it was a gift that was not needed. I have sent the buyer notice of my intent to file fraud charges and/or whatever type charges are necessary. The buyer has not contacted me and has no intention of paying for the unit or returning the original. I am in the process of informing the authorities in Tulsa, OK and the post master general, among other authorities.

I would contact tivo. Since the tivo units ALL have unique serial numbers, the one that he is using is YOURS then one of two things should happen
Either tivo has him using your tivo (which will be helpful in the court case)
OR
if he has NOT registered your tivo then cancel the service on it...either way it will be a pain in the rectum for him.
This is of course assuming that you do have the serial number to the unit!
If you do, and he is using it then you should have yourself and open and shut case of fraud! The only 'slight' problem is that you will find that tivo is not very helpful and you will probably need a court order to get tivo to release the records of the thief! Wont be hard for the attorney but keep in mind the cost...I doubt that $500 of attorney fees would be worth a $300 tivo.
I sued someone and won over a tivo.
I filed civil court and the loser had to pay my court costs. It took a very long time (5 months) but it was really worth it to me. YOU have to decide if it is worth the hassle to you
