SKS Associates Northern Leasing Charged Business Account 2x 195.00 each New York, New York

March 7, 2011 SKS deducted $195.00 twice from my business account.  On 3/8 I tried to dispute the charges but the bank was closed for Mardi Gras.  When I spoke to the bank on 3/9 they told me I was too late to dispute because I had to do it within 24hrs.  SKS Associates sent my bank the two contract that were signed, 1999,  for 48 months but of course I paid for the equipment until 2008 because of the difficulty  I had trying to cancel the contracts.  The bank felt that SKS had every right to charge my account and if I had a dispute I should contact SKS. 

I filed a complaint with the Comptroller of the Currency (online) which handles complaints for national banks.  May 2011 they replied in favor of the bank but told me I could write an appeal to CAG Management which I did.  The appeal letter addressed the out dated contracts, the contracts had Northern Leasings name on them not SKS and the dollar amout was $49.00 not $195.00.  In other words SKS did not have authorization to withdraw money from my account.  

Between May and July my bank did a merger so  CAG Management forwarded my complaint to the FDIC who in return forwarded to the State of Louisiana Office of Financial Institutions (OFI).   OFI sent the complete package to the bank on July 22 and asked the bank to respond  to them within 14 days with any supporting documentation to support their position.   On August 16th the bank wrote a check and a letter of apology for any inconvenience.  You must go after the bank.
