It is possible per a Retrospective Review by International Healthcare Consultants in Marietta, GA by Dr. Charles F. Nicol, that adjuster Vanessa Ennis of State Farm, SIU, Panola Claims Office, attempted to coerce this doctor to change some of his answers regarding my medical review.

In his reply to a "second" letter to him from her, he writes, "I see no reason to change any of my answers." Ultimately the investigation concluded and the medpay was paid out. However, it is to be learned whether a separate UI policy relative to the accident can be use as a source of recovery. This adjuster possibly made an attempt to coerce Dr. Nicol to write something that would affect the outcome. I have been unable to get a reply from him about this to date although I have called, faxed, emailed, and written via US mail.

Replies from State Farm focus on everything except the question of her possible coercion. This is the same adjuster who refused to identify herself to a local auto repair shop owner and who hid her car (with her in it) behind a shop building roughly two miles from my home.

This is the same adjuster who mailed a plethora of medical documents of mine to a neighbors home. She had mailed items to an even separate neighbor before that. Upon protest, her manager, Brett Suitor, writes that he is "concerned you are not getting your mail." Well, no, not when you mail it to my neighbors. He ultimately forced her to write to me a letter of apology.

I have contacted the GA Governor's Office of Consumer Affairs and just got a letter from John Oxendine, GA Insurance Comm. that he had placed a special investigator on this matter.

Is this bad faith? It is certainly bad behavior.

State Farm, Georgia Medical Payments Med Pay Office, adjuster Vanessa Ennis, Panola Claims Office, OCR complaint filed

AUTHOR: Jeff meadors - (U.S.A.)

The following complaint has been registered with the OCR re: possible HIPPA violation(s).

Pursuant to an investigation into personal injuries sustained in an automobile accident, adjuster Vanessa Ennis (State Farm) hired Dr. Charles F. Nicol of Marietta, GA (International Health Consultants) to review a large number of my medical records to determine if my medpay should pay out. The medpay did pay out the 25K, however, in a letter back to Vanessa Ennis of State Farm from Dr. Charles F. Nicol in the second "Retrospective Review," Dr. Nicol writes in reference to a "second letter" from Vanessa Ennis dated March 24, 2008 that "I see no reason to change any of my answers." Multiple attempts to obtain an explanation from State Farm or from International Health Consultants have been fruitless. I have written by fax, email, called them, and sent US mail to them. No replies. I have tried since May 8, 2008 to get this data. It is clearly possible that Ms. Ennis attempted to coerce Dr. Nicol to alter and/or change my medical records and/or the report he constructed on my medical records and subsequent injuries. Since State Farm eventually paid out the medpay, it appears to me that her second letter was unsuccessfully coercive. No one at State Farm ever gave me copies of the medical/paper review. I never met Dr. Nicol. I obtained the review purely by accident from a medical doctor who had treated me extensively for injuries following the non at - fault accidents. This followed on the heels of Vanessa Ennis mailing over 28 pages of medical papers about me personally to my parents' home at a separate address in the same town. She had also mailed records to a separate non-relative neighbor. It appears that she plays fast and loose with privacy issues and medical data. I have repeatedly asked for a copy of her second letter to Dr. Nicol. I have not received it. Her manager, Brett Suitor, will answer everything almost except the questions about the possible coercion and why Dr. Nicol would state "I have no reason to change any of my answers." Please assist me. I have copies of all said documents. If indeed the letters and /or an investigation reveals that she did attempt some sense of bad faith coercion in any manner, then it makes all of her work on my claim suspect to me.

#4 Consumer Suggestion

HIPAA Violation

AUTHOR: Noir - (U.S.A.)

If your insurance adjuster mailed copies of your medical history to your neighbor without your consent, she may be in violation of federal HIPAA laws. I do not know if HIPAA laws apply to insurance companies who receive your medication records, but you might check with their web site for your rights.

Under HIPAA you do have rights to access to all your medical records, and I bet an attorney could make an argument that correspondence to your doctor would fall under HIPAA laws. Call your doctor's office again and give them a timeline for when you will be picking up a copy of your records or you will file a HIPAA claim.
