However CACV of Colorado/Collect America/Scott Lowery have since filed a suit against me and raised the amount of what they feel was owed from 7600.00 to 16000.00. THey have also stated that I was notified of an Arbitration by some company called National Arbitration Forum. I was not notified.
On January 3, 2005 I was awaken at 6:45 by a process server for these people screaming my name, demanding that I open my door and banging on my windows. At that time of the morning I wasn't dressed for visitors and needed to change,the server continued to scream and demand that I open the door or he would tell my neighbors that I was a deadbeat. All this for a credit card that I am in the process of proving I did not have. I took this case to a local attorney which angered CACV of Colorado/Collect America/Scott Lowery, they have threatend sanctions on her practice and have initiated goon like tactics to make her drop my case. These people must be stopped. They are in violation of the debt collection practices of the United States.

First, WHO is Jeremia? There is no Jeremia in this entire thread.
Second, You do not have to open the door to the process server. They can stick it in your door or tape it on the window, etc. That is all that is required. You do not have to get it in your hand or sign for it to be valid.
If you ignore the summons, they WILL win AND get a default judgement against you, AND garnish your paycheck and bank accounts as allowed by law. Well, TX excludes paychecks from garnishment.
You MUST respond to the summons and the lawsuit. It WILL NOT just go away. AND, it is actually easy to beat as most of the time these junk debt buyers cannot properly validate the debt anyway, and it gets tossed.
NEVER let a junk debt buyer/debt collector win by default! ALWAYS fight them.

One of the largest debt buyers, a bottom-feeder organization in America that purchases old accounts, inflates them and attempt to collect. In 2005, Collect America owner Phillip Scott Lowery reportedly sold his operations for $350 MILLION to an organization called First Analysis Private Equity Fund IV, in collaboration with co-investor KRG Capital.
The Collect America system is comprised of approximately thirty franchisee's across the country, with an attorney name on their door. Some of the attorneys such as Sam W. Streeter of Houston, have been dubbed ?Rent-A-Lawyers' due to their total lack of debt collection law and Fair Debt Collection Practices Act (FDCPA) experience.

Since the sale of the main organization, Denver Attorney Phillip Scott Lowery and his collectors that include attorneys David L. Michael and James R. Wolf have relocated to the Cherry Creek Drive address. Scott and wife Texie have moved to Vail, CO, however he reportedly still is involved in the day to day operations through son Arthur Todd Lowery.
CACV, LLC which stands for Collect America Collection Vehicle and CACH, LLC (Collect America Collection Holdings) are the debt purchasing arms of Collect America. Lowery and associates reportedly purchase these accounts for amounts that average $ .02?-03? on the dollar, then inflate those debts to astronomical amounts they attempt to collect on. Collect America does place these accounts on credit bureau reports under the names CACV, CACH and Collect America. Under provisions of federal law, the Fair Credit Reporting Act (FCRA), they may NOT stay past the date of last activity as stated by the original creditor and the information and amounts reflected MUST be accurate, as stipulated by federal law.
The ONLY thing that can restart a ?date of last activity' is by YOU making a payment, Collect America cannot change it under any circumstances. You should always obtain copies of your credit reports directly from the credit bureaus to compare those dates. You have the right to dispute any debt buyer account found on your credit reports as ?Not My Account? with the credit bureaus. Always keep copies of credit reports tucked away to prove the validity of dates with the original creditors. If you feel Collect America or anyone else is changing those dates, you may be able to take legal actions against them in federal court for violating the law. If you are ever sued by a Collect America attorney it is VERY important that you respond to that suit. A lot of attorneys working debt collections have reputations for not being real bright and Collect America is no exception.
