Illegal Practices - Sears + Experian

AUTHOR: Syler - (United States of America)

I assure you Sears does knowingly report false information to Experian and Experian is at least negligent if not complicit in their false reporting.  Right now I am trying to get Experian to remove an old credit card account from 1996.  The law requires them to remove deragetory remarks after 7 years.  And the debtor can not renew the bad debt or transfer it.  The law goes by the date of original charge off.

I filed a dispute and all they did was updated the reporting date on the 15 year old debt.  When I was on the phone with them attempting to dispute this along with the other several open student loans that were supposed to show closed and paid, I was talking to a guy in a call center in India who tried to tell me that Experian has to report what Sears tells them.

The fact is, once a dispute is filed, the burden of proof is on the party reporting the debt.  Evidently, Sears just lies and Experian just reports what ever Sears tells them to.  I will be filing a claim with the FTC if the remark is not removed.

Excuse Me but the so called expert is WRONG!

AUTHOR: Melody - (U.S.A.)

The FCRA is not the Fair Credit Reporting Agency!

The FCRA is the Fair Credit Reporting Act.

You can read it yourself at www.ftc.gov

It outlines your specific rights, however enforcement is handled by the FTC. Or in the case of inaccurate reporting the consumer through legal redress in the court system.

The law provides for its own damages even if you sustained no provable financial harm.

If it is determined in civil court they violated the act they are punishable.

Period.....this will require filing in small claims, or highering a lawyer.

While the FTC with take your FCRA compliant, they watch for trends in the credit reporting bureaus and act when there are a bunch of consumers involved, they do not take on individual cases.

Hope this helps.

Oh and the former Sears employee, you do not know crap about credit.....and your ignorance is exposed.

Rip off not true

AUTHOR: Danise - (U.S.A.)

I work for Sears. We would not rip you off over your credit rating with a credit reporting agency. If you have problems with a credit reporting agency, contact the Fair Credit Reporting Agency(FCRA) to have them investigated. If what you claim is legitimate, they will help you and also give you other agencies to assist you. You can also put a consumer statement on your credit report that explains your situation if all else fails.

When you signed up for the account with Sears(or received term changes), you agreed that Sears can use the information reported by these credit bureau agencies, to maintain your account with Sears. This is what Sears did within the parameters of the regulations of the FCRA.

Sears has the right to protect themselves from an opportunity that may cause a loss for them. This is not a rip-off; it's the law.
