Judge finds Lawsuit against SingSnap and CEO Trevor McGuire frivolous

On August 25th, 2011 a lawsuit was filed against SingSnap.com founder and CEO Trevor McGuire as well as three other members of the SingSnap website. This lawsuit filed in Pennsylvania Federal Court by Diane Patchen and her fianc Robert Smik, alleged, among other things, a conspiracy to defame and copyright infringement. Eatsleepmusic Corporation, owner of SingSnap, was later added as a defendant.
Diane Patchen was banned from the SingSnap community in February of 2010 and soon after made numerous inaccurate posts around the web regarding Mr. McGuire and his business. Filing this lawsuit against him was, Mr. McGuire believes, the culmination of her vendetta. As soon as the lawsuit was filed, it was publicized on dozens of Internet complaint boards by anonymous posters.
McGuire and SingSnap immediately retained counsel to fight these ridiculous and baseless allegations.
On September 27th, 2012 the Judge William H. Yohn Jr. of the United States District Court DISMISSED all of the Plaintiffs claims and Denied the motion for severance and transfer of the claims as not in the interests of justice because the claims were frivolous. The parties later resolved the litigation, including motions by McGuire and Eatsleepmusic Corporation seeking sanctions and their attorneys fees, to the satisfaction of all parties.

Beauty is in the eye of the beholder.
Everyone is beautiful in their own way.
I do not think that personal remarks about the former defendants appearance will help you now.
These people could look like the elephant man for all people care. You still lost.
Most people, while perhaps not catwalk models still have beauty on the inside, not a black soul intent on inflicting as much misery as possible. I wonder what you see when you look in the mirror each day, how you sleep at night and how you can live with the guilt of spreading your hate as far and wide as it can possibly go. There will come a time when you will ask for forgiveness, I hope it is denied.

One has nothing to do with the other, eh? Oh, how wrong you are! You obviously owned or at least partially owned that hate site, you know, the one responsible for posting defamation and libel all over the Internet for two years or so? You may think we are all stupid but we are not. As for crazy... I think a trip to a doctor may be wise for you (before someone forces you there).
That hate site was behind the uploading of a video my husband made on SingSnap... THAT was copyright infringement since ESM owns the video. DMCA did a take down on it otherwise I would post the URL now. It's just as well though since I really don't care anymore... there are much more important things to me now. So, grow up, get over it, move on... surely you can find something better to do in your spare time (at least until your time is up).
December 3rd... that's 2 days before my birthday... maybe I will get my wish.

First of all, most men prefer their women to have curves. Unless they prefer men of course, or a close facsimile thereof. I can't figure out why a woman in her sixties would be referring to others in a ridiculing way regarding perimenopause. Shanda and Katie are beautiful, talented and happy women and you are jealous. Katie has had several careers you say? Well at least she has one! You do too I guess if being a Hater counts. It seems to be full time work for you and you are dedicated to your craft but this does not look very good on a resume.
Another point that needs to be clarified is the constant references to the Plaintiff and the Defendants. This should be former Plaintiff and former Defendants, cause this case is closed. In fact the former Plaintiff is now on the defensive in the next hearing but that is another story. Also, the former Plaintiff lost her case. She tried and she lost. It seems even the other haters have abandoned her.
More threats of continued litigation I see. This is too funny to pass up. Not going to happen. Not notwithstanding the fact that there has been no crime, there is no lawyer on the planet who would take this case on given the current ruling and the pending hearing for sanctions against the former Plaintiff and her attorney.
This case has ten foot pole marks all over it. (for you haters, this means no one would touch it with a ten foot pole, further simplified, it ain't gonna happen Bertha! LMAO)
You must be in an absolute rage having suffered such a damning defeat. A complete loss. It must hurt all the more given your bravado at the outset, how you rallied the haters around you to spread the word when you filed this frivolous lawsuit. Now everyone is laughing at you. You have no idea how much joy your lunatic ramblings are giving people. Very fitting and unbelievably satisfying.

the screen shot u posted has no relevance regarding the plaintiff as you said in a previous comment you posted her video for tit for tat. if u had issue with the site why go after the plaintiff personally? the date of that video is april 9th. it is your hubbys nic . It still does not explain why no1knows is on the email from youtube in regards to the link you admitted sending to singsnapsucks2. but then again as another posted mentioned you accused her of being the owner of this site which was libel.
the burden would be on you to prove you did not use your hubbys account to upload the video to youtube of Diane. You said investigation will prove who it was that uploaded that video and you still claim it came to you anonymously. no such thing if there was an email address that the link was on. and again the chances of just coming across a video on u tube are one in a million unless you did it or u know who did it. but keep on with your stories they are amusing and well u did say u did not care anymore. you should.

u are confused. no one is saying that any video of your husbands is on your u tube channel. what the other poster was saying is that when u sent the email from your ALLhatersSUCK account from u tube what u probably did not notice is that youtube mentioned the actual name of the uploaded song onto the other account allthehaterssuck. It was probably missed by the plaintiff because perhaps she had no idea what your hubbys account name was. it was probably brought to her attention by someone who did know and maybe too late to show u lied once again.

back to shanda. what u did was and one only knows at this point who gave u the video in question to down load to your computer and we could guess i suppose being only one person would have access to a persons closed account of their hard drive. but that is besides the point. what u did when it was down loaded was to remove the name that would appear ie. singsnap sexyback by Ladydi821 and put on that flv no1knows so when u uploaded it onto that other account you made to display it on u tube they only picked up the flv name which you will see in the email from pacer. if you can explain away why your hubbys name is on an email from u tube please do we all love to hear you explain away things u do.

the judge although made a lot of comments. the case was dismissed on personal jurisdictions. the need for the judge to post the whys and laws for each state is expected of him. but again for those not paying attention. dismissing a case in civil court regardless of no severs granted in this case. the plaintiff is free to refile in their jurisdiction. it is was his opinion not to sever 2 defendants. again u all should maybe before claiming a victory should see what another judge may think. not all judges will see things the same way. good luck to you all for the second go around that will most likely happen. sure can't wait myself to see what the plaintiff decides because imo knowing all the people involved u all deserve what u have coming to you. tit for tat as shanda put it right. how shanda turned this all into about her amazes me. the woman spat crap out of her mouth this past yr that was amazing and then switches up to the holier than thou crap. she knows what she did. you all do. and u all lied.

ur the complete idiot or idiots. anyone can pick and choose how they want to read into something. copyright was not the only issue in the case was it? and because a judge in the state of Pa said he doesn't think something would hold up doesn't mean new suits on other things not mentioned can't be filed for. so again if the judge thought this case held no merit at all he would have dismissed it with prejudice meaning that the plaintiff can not sue again. he did not do that. nice try too on the shanda messing with people. try she missed something and now is feeling a bit cornered. so maybe while u may feel the plaintiff should not sue in each jurisdiction of each defendant is a waste of time. u are entitled to your opinion. pretty sure her legal counsel would advise her what to do and what can be done. see people who think like u is the reason why the laws need to be changed. u still have that tone of harassment even typing here. but keep on posting in a negative manner calling the plaintiff names and calling it a playground spat and see where that gets ya lol that is what ya all said it was right? i think i am going to send a letter to the judge lol and tell him what a bunch of losers u are not being able to comprehend his words. u need an attorney to read it to u and pretty sure u had none all along while being sued. that too is on pacer who is represented and who is not. looking forward to see what happens next. in the mean time i am writing a book on this lol

News Flash for the Haters: This case has been dismissed. The judge said it was "frivolous". He also said the Plaintiff has no rights in the video. I wrote the wrong acct name regarding the email sent to singsnapsucks2.
It should have read..."allhaterssuck want to share a video no1knows.flv with you". (The allhaterssuck acct uses some capital letters. For simplicity, I've left them out).
So, making things even more simple...
Shanda put her husbands ss acct name on Dianes video... uploaded it to the "allthehaterssuck" acct
Then, from her other acct of nearly the same name "allhaterssuck" she sent singsnapsucks2 the email giving them the link to a video by "no1knows" thereby connecting Shanda to both "haterssuck" accts when she made the mistake of renaming the video with her husbands info. Theres no need for a subpoena (although like I said before I believe the plaintiff has already had this info for quite some time now) because this is finished already by failing to think this through.
It was simple revenge for thinking and assuming Diane had posted her husbands video. Retaliation.

Shanda put her husbands ss acct name on Dianes video... uploaded it to the "allthehaterssuck" acct
Then, from her other acct of nearly the same name "allhaterssuck" she sent singsnapsucks2 the email giving them the link to a video by "no1knows" thereby connecting Shanda to both "haterssuck" accts when she made the mistake of renaming the video with her husbands info. Theres no need for a subpoena (although like I said before I believe the plaintiff has already had this info for quite some time now) because this is finished already by failing to think this through.
It was simple revenge for thinking and assuming Diane had posted her husbands video. Retaliation.

u say u did a tit for tat because someone posted a video of ur husband? what in the hell does that have to do with u commenting and sending a video of the plaintiff to this site? ur intent was not to harm the site it was to harm and embarrass the plaintiff. u had already been involved prior to the video in harassing the plaintiff under several fake names on another site. So u admit u sent the link via email. now the nutty part is u say you have no idea who sent u that video. so are we to assume then it came to you with no email address? that email address would be on ur computer even if you deleted it. but it all sounds a bit off because anyone with half a brain would know from the case on pacer you had it in for the plaintiff. and whoever it was that sent that video to you also did. it doesn't really matter because like you said with investigation of both your hard drive and u tubes assistance it can all be revealed at some later date. here is to hoping u did not ditch that computer. that too can be found out with investigation. u seem to have a thing about people who want to spend or waste their money. well maybe for some people it is all worth it for the truth to be revealed. u seem to think this was all some kind of game u were playing. pass the video around lol. good luck

The link was sent to me anonymously so I do not know who uploaded the video; I am not covering for anyone. I SENT the link to SingSnapSucks because I felt it was tit for tat... after all, SingSnapSucks YouTube username stole my husband's video from SingSnap, in which he defended me, uploaded it to YouTube, and then belittled him in comments. I'm sure that can be proven as well. Personally, as I've stated before, I don't care about any of this anymore. He who has not sinned, cast the first stone..!

well, okay so u are saying u didn't put the video on u tube but it is clear from pacer you were the messenger. I don't think i need to upload the exhibits on pacer that clearly show you sending an email from your present u tube account which is dated as opened the exact day the video was put on u tube with the little note that says your account has shared a video.
so what are we to assume then? there is no way in hell you came accross that video by just surfing u tube. odds are better to win a lottery than to just come across a video. so you know who uploaded it but won't say. so you want someone to go find out who it was. see what is kind of odd is why you would even get involved with the person who sent you the link and send it via email to the person whose video it was. see now u being a christian woman if u really were one would have to had said i will not take part in this and walk away. but you didnt do that.

The reason I can honestly say I did not upload the video is because I DID NOT. That FACT can be proven through computer forensic techniques... whomever wishes to go to that extreme (and expense) will find out WHO uploaded the video. That is all I have to say on the matter.

Oh, one more thing... my mother and father both loved me very much and they were proud of me. I know because they both told me so. I am not the evil person certain people make me out to be by LYING. My family knows it... my friends know it... I know it... most importantly GOD knows it.
The cross I wear around my neck was given to me by my husband over 10 years ago. I've taken it off 3 times since then (because of my son's c-section and medical tests). I wear this symbol of faith because I love GOD above anyone and everything. It is a way to testify to others.
I pray for my enemies daily because it is what GOD wishes of me. I don't mind having enemies... it means I stood up for something... oh, yes, I DID and I shall continue to so.
If thine enemy be hungry, give him bread to eat; and if he be thirsty, give him water to drink:

The fact that you were so quick to make a post that the case was dismissed and justice was served once again proves you are not too intelligent. You have been known to be caught on many different complaint sites stating you can interpret the law. Did you read why the case was dismissed? It was based on jurisdiction. It was not based on a case with no merit.
So, it may be your grief that is blocking your brain cells at the moment but do you really think a law suit just goes away like magic? Maybe in your world. You use the word ruined? Who has ruined you? You should be ashamed of yourself for being the liar you are and for the things you were accused of in that complaint filed. Not only you but the other bozo's who played along and the people you played along with.
An early Merry Christmas to you. I would imagine coal in your stocking would be more welcomed than what you will be receiving. But, Virginia there is no Santa Claus

...all you people can spend your time slurring me up one side and down the other all over the Internet but if I defend myself in a civil manner I am the devil incarnate? Carry on then because it just doesn't matter to me anymore. I'm changing my settings here so I no longer get alerts when someone posts. Besides, people who know me understand what you people say is ridiculous. My husband says y'all should stop sniffing glue 'cause it does dain bramage. :D

Well first I would like to say. The eye rolling and sighing you do must tire you out. Next again the guessing game of who is who.
We all wonder how it is Shanda knows who everyone is on this site? Do you know who I am? Of course you don't. But I am pretty sure you will say you do. Go for it!
We all know who you are. We all know you are the obsessed person here. We all know that Shanda needs to prove she above the entire world. We all know she is a self proclaimed Christian yet she doesn't act like one. We all know she has to be right or you are on her shit list. We all know although she pretends to not be afraid of anyone she is afraid of everything. We all know Shanda has created a persona on snap as this person who is compassionate and kind and a huge advocate against hate of any kind. We all know that to be a huge lie. I could go on and on but what's the point? She will just say it's libel lol.
One would have to wonder why anyone who reads any of this crap could care less how pretty your ring is. And the need to post it no less. I am sure not a soul really cares.
Well Shanda, What's next for you? Where do you see yourself a year from now? Still playing games? Still professing to anyone who will listen what a wonderful human being you are? That you forgive? You don't forgive. If you as you claim have forgiven and moved on, why are you still posting here? And exactly who is you're posting to? About who? You are so confusing that no one can keep up with your outrageous rants and accusations.
Do yourself a favor. Make a New Years resolution to shut up and as you claim you have better things to do with your time, energy and money, stick to your own words. Go find a hobby. Go feed the poor, save an animal. But for God's sake stop making a complete a** of yourself here. And trust me you look like an a**.
You are like a child who must have the last word. I am positive you will need to have the last word here too. If you actually can stop yourself, I myself will give you an award.
2012 is approaching and perhaps you will actually move on and be a productive human being. Now that would be a miracle! You believe in miracles don't you? I wish I did. If I did then my first one would be is to see you actually behave like a grown woman instead of a whining child. I would ask your God but I don't believe in God so my only resource would be to ask you to grow up.

Unlike some folks I am not a 'sue me baby'. I've been raked over the coals via Internet but I prefer to just forgive and move on. I really have much better things to do with my energy, emotion, time, and money.

I think you should sue also. I mean, of course if it's untrue that three people appointed admins on singsnapsucks last year matched up your ip *99.179.112.116* to MULTIPLE fake accounts including all the names mentioned above (and some not even mentioned).
If you have every receipt from your income (outside of your disability income) and have receipts from the charity (s) you donated it to, then yeah...you should sue.
If you can show your web site posted the information about all proceeds going to charity BEFORE you were questioned about it, then that would be something. You know, not added afterwards. If saying that Mrs. Maddox is currently under investigation with a private party regarding internet harassment and libel is an untrue statement, then H**L YEAH, you should sue except for the fact that Maddox was a name used by you at some point during your life so, you own it. You should also sue if you're not under investigation and not being sued for harassment and libel but wait...
Not only are you under investigation, you WERE investigated, sued and then you LOST the bloody case. The federal court found you guilty of ASSAULT, LIBEL, HARASSMENT, SLANDER and COPYRIGHT INFRINGEMENT. Now, if there's some way you can show this isn't true, then by all means, sue, but usually, under most circumstances, evading a federal lawsuit multiple times don't have happy endings.
If you're LEGALLY married, then you may want to post a copy of the marriage cert online. Recent investigations cannot locate any legal marriage doc on you. All studies done show you as single. Common law marriage does not jive in the state of Tennessee as Tennessee does not recognize any common law relationships as "marriage".
Your own words state your parents purchased the home your currently reside in and after you make "improvements", some type of plan will be made to somehow change ownership in the future. You do not own this home at present. In fact, you could not qualify for a home loan under your present circumstances. I mean heck, the sale date of the house and how much it was sold for is easy information to find. Finding the name of WHO purchased the home is easy information to find.
So, take all you feel is terribly untrue and libelous and please, get a lawyer.
