We bought our mattress 2 years ago and about 1 year ago the side of the mattress started to give. It got worse and worse until now if you lie anywhere from the middle toward the side you feel like you are going to roll right off the bed.

We went to our retailer to ask how to file a claim and they gave me a form to fill out and we needed to return it to them with a fee of $59 to file a claim. We thought this was ridiculous so I emailed the company and they responded that I had to go through the retailer and basically told me that it was too bad that I had to pay the fee.

We filed the claim without paying the fee and the retailer too the claim. We had to go back to the store several times before they filed it. The retailer called and said that Simmons says our claim was denied because the warranty only covers the top of the mattress. It wasnt the top that was sagging it was the side. Even though the side is out 8 inches and the top sags due to lack of support. This is one of those mattresses that you do not flip. But even though, we turned the mattress regularly.

Did the retailer provide you with a written copy of the deision on the warranty

AUTHOR: Aafes - (U.S.A.)

Did the retailer provide you with a written copy of the decision on the warranty? If you go to the company website and review the warranty procedures this is required. I think you should call the company and insist on speaking to a supervisor or manager.

If you receive no assistance from doing so start writing letters - write to the company and address your letter to Chairman, President, and CEO: Charles R. (Charlie) Eitel. While it is likely HE will not personally read it an executive assistant likely will. It may be passed on to a lower level customer service manager but you will likely get attention.

A plea for constructive answers please, all others need not respond. Thank you.

AUTHOR: Michelle - (U.S.A.)

You obviously have never had to go through this process because I was never asked to write a letter, just send pictures. They never even came to my house and looked at the bed, they just denied the claim based on pictures. I am not trying to sue you or anyone, I just figured that on this site I would get constructive answers for my problem not accusations from someone who either works for the company I have a problem with or has nothing better to do but upset people.

Your words, One of you is much heavier than the other, so I am going on assumption that the heavier person's side is sagging, and You broke the mattress and Both of you the same weight huh? Well now, average guy weighs 180.. hmmm. Were meant to hurt and are not constructive answers. Plus, if the mattress was TURNED then both sides would be sagging and they are not, only the one side. And I have never had that kind of problem with a bed before.

So, sue me for assuming you flipped it. And I never said that the heavier person broke it, I said that would be the sagging side. You didn't read what I wrote! What I wrote was that IF you flipped it, you would've had problems, you interpreted that to be a manufacturer's defect. No wonder you were denied, you probably wrote a tirade of accusations and assumptions in your letter to Simmons as well. Both of you the same weight huh? Well now, average guy weighs 180.. hmmm

You need to read my story more thoroughly

AUTHOR: Michelle - (U.S.A.)

I didn't say I FLIPPED the mattress, I said I TURNED it. Meaning I put the head at the foot and the foot at the head, which is what the salesman told me to do. And I want to state that you are assuming that one of us is much heavier than the other but the fact is that we weigh the same so your theory of how the heavier person broke the mattress is also incorrect. Plus if a heavy person could break a mattress after only one year, and this was an upscale model, then there was a manufacturer defect.

#13 Consumer Suggestion

You shouldn't have flipped it

AUTHOR: Dave - (U.S.A.)

Those mattresses have a variable coil-load level system in them. The reason you don't have to flip them is because the leveler system keeps the mattress firm only on one side. When you turn it over, that leveler is working backwards, so to speak, and it's actually doing the opposite of what it's supposed to do, so when you lay on it, instead of providing resistant support, it gives way, because now the pressure is on the other side of the mattress, so the load system is actually pressing against the box spring instead of you body. One of you is much heavier than the other, so I am going on assumption that the heavier person's side is sagging, unless when you flip it, you flip it opposite of the way it was laying (left to right). In that case, it would sag on both sides eventually.

That's the reason they say not to turn it over. You broke the mattress. Sorry.
