South Bay Expressway Phony Charges San Diego, California

On March 18, 2011, my daughter and her friend, driving back to the Bay Area from San Diego, not familiar with the area, took a wrong exit ending on Otay Lakes Road entering in the northbound direction, as well as it was nighttime, they did not see the toll booth charge.

On April 1, 2011 we received two toll evasion notices for two different citation numbers for the same toll evasion incident with the same account number. On both evasion notices, we were given two payment options: a) pay 3 dollar toll plus 10 dollar penalty and b) pay 63 dollars if we did not accept the charges.

I wrote South Bay Expressway questioning the two different citation numbers with the same account numbers for the same toll evasion incident. I also enclosed a payment of 13 dollars for option A.

We did not receive any response to our question from South Bay Expressway, until December 7, 2011 we received a notice of debt from a collection agency. I wrote a letter to the collection agency explaining above as well as enclosing a copy of my letter to South Bay Expressway plus a copy of the return check for the amount of 13 dollars. 

On July 26, 2012 we received a second notice from the collection agency for demand of non payment for 103 dollars.
