Southside Kia, Jacksonville, FL Finance Manager refused to cancel extended warranty and said I would have to pay for it and wait 8 weeks to get a refund even though I cancelled 2 days after the sale. When we refused to pay for it, they threatened to take our new car back & keep the money we paid and even blocked our car in at the dealership to prevent us from leaving and threatened to arrest us. jacksonville Florida

We purchased a new Kia Soul in November, 2013. Two days later, due to medical bills, I called the Finance Manager of the dealership and requested the extended warranty be cancelled. He was obviously not happy (I think the dealership gets a commission for every extended warranty they sell).  Nothing was said about signing any paperwork to cancel the warranty and other than his attitude on the phone, we thought all was ok.  I spoke with 2 other people at the dealership later that week and none of them acted like anything was wrong. 

When we went in to finalize everything, we were told we would have to pay for the extended warranty and wait 8 weeks to get our refund. We declined to do that as we already called to cancel it and advised them we had not gotten any paperwork about the warranty and they still had time to cancel it. I was told we would have to take our trade in back and they would take back the new car. I was fine with that, as I did not like their attitude and was ready to take my business elsewhere. When I asked where my trade in was, I was taken into the finance manager's where the New Car Sales Manager came in and was very nasty. He told me he was keeping the money I had already paid toward the new car and I would take my trade in back.  When I tried to leave and get some help, they blocked my car in the dealership and threatened to have me arrested.  I went back in the dealership and the general manager, got involved then.  He was very nasty as well and said I bought a new car from them and was stuck with it.  He said to leave and everything was all good.  When I asked him to put that in writing, he refused. 

Approximately 2 weeks later, I got the warranty paperwork in the mail, so obviously they never had any intention of cancelling the warranty.  I called the company and asked them to cancel it.  I was told I would have to go back to the dealer, sign a cancellation form and the dealer would have to send it to them.  I have sent emails every day since with no response from the dealer. Finally I called the warranty company back and advised the dealer would not answer my requests and refused to provide me with the necessary paperwork to cancel the warranty.  I then had to send the warranty co. a letter with a copy of my contract and I hope they will contact the dealer to cancel. 

Now the dealer has finally responded and said they will cancel the warranty but I have to pay for it first and wait for a refund.  Right - I'm sure I will never, ever see that money if I pay it.  The warranty paperwork says the longer it goes without cancelation the more money they retain.

In one of my emails, I advised the general manager,  we wanted to settle this situation and would never bother them again. They are still demainding we pay for the warranty and wait for a refund.

It's unfortunate a dealer is willing to go these lengths to make a commission and lose a customer over this.  They obviously have more money than the typical person and can pay for the warranty themselves, since they didn't cancel it as requested, and wait for the money to be refunded to them, but no, they want to hassle us.

I've filed a complaint with the corporate office of Kia, but found out each dealership is a owned like a franchise so all they can do is put a complaint in the file. 

One last thing,  the general manager also refused to let me speak with the owner of the franchise.  I was told he doesn't get involved in the day to day business of the dealership. Wow! If my name was associated with the dealership, I would definately not want my name tarnished over this type of situation.

Thanks to the General Manager, Chuck Golden, we were able to get things with the extended warranty resolved yesterday.

You are soooo right about the warranty companies

I did what you suggested about Googling the warranty company.  Guess what, I found a complaint on this site, ripoffreport.com from another customer.

The name of the company is Fidelity Florida Warranty, 500 NW 12th Ave., Deerfield Beach, FL 33442.  I found out from the person who filed a complaint on ripoffreport.com, this is actually a division of a company called JMA Group.  I called them today and that is how the phone is answered, JMA.  The phone number I have is 800-553-7146. The below are notes from the ripoff complaint:

I'm really mad at myself as I usually do my homework by checking the local Better Business Bureau and Consumer Complaints.  Boy did I get into a big hurry and really hurt myself.

I greatly appreciate you telling me not to pay for the warranty we cancelled.  My husband suggested we pay for it and wait for the refund to get the situation resolved.  Apparently this will not resolve the situation, as I'm sure we won't get our money back for the warranty. 

Now I wish we had financed the deal, but we paid by check along with our trade in.  Live and learn! 

I'm going to contact a civil attorney and see if they can help us since the dealership has not processed the title paperwork and I'm sure they won't until we pay for the warranty. I am going to send them another email today and paste all the complaints I have found online. Shame on that finance manager and also the new car manager for such disgraceful tactics.  You are right, all they care about is their commission and I believe you are right in saying all the warranty company cares about are them since they bring them repeat business.

My one hope is the manufacturer sends me a survey, as I was told they would do.  The dealership really stressed we needed to put they provided excellent service.  When I purchased a Toyata several years ago, they also told me to please put good remarks on the survey. They said the surveys make a difference on the number of cars the manufacturer will provide to them to sell.  Let's hope this dealership has problems getting more cars after my comments on their survey. 

I am also going to Google the name of the dealership and see if I can find out the owner's name. I will then send him a certified letter about how his dealership is being run.

Thanks very much for taking the time to respond. I am going to do exactly what you have suggested. It makes me feel better to know there are people out there who want to help others! 

I'm greatly appreciative for the person who started this website to allow consumers who have been ripped off to share their experiences with others to hopefully prevent them from experiencing the same situation!

Report this dealership to the Fl State Attorney General's office and also to dealer review web sites

It's great you took the time to come here to report this event on Ripoff Report. Thank you for your well written report. But in my opinion I would also contact the Florida Attorney General's office to report your experience with this dealership and as many auto dealer review websites that you can locate. 

What that dealership did is inexcusable. You did the right thing by contacting them to cancel the warranty in a reasonable time frame (two days) and then they tried to strong arm you into paying it anyway.

If the Attorney General's office gets enough complaints about this dealership they will have their francise revoked. I hope your complaint is the one that get's the AG's office in action against this company.

Southside Kia reviews. Little information for the unhappy customer about finance managers and extended warranties

Dear unhappy customer let me tell you some information that might help you. Many finance managers will do anything they will tell you anything to sell you anything to put extra profit in their pocket personally trust me I know what I'm talking about. I have seen dealerships pay as little as $400 for an extended warranty Policy, Then they will sell it to the customer for as much as $2600. And you can take the statement to the bank the list of things that the extended warranty does not cover is much longer then the list of things that the extended warranty will cover.

But I'm sure that the extended warranty company and the dealerships finance manager will never show you the list of things that the extended warranty does not cover and trust me that list is very long.

Did you put any cash down when you bought the car ? A question about the contract that you sign that long piece of paper that was pink or yellow or even maybe white, that reflected the interest rate that you were going to pay ?

Auto lenders when they finance a car for a customer want to know if the dealership is allowing you to finance the extended warranty. It must be itemized in the contract where the lender actually knows what you are paying for the extended warranty that you are trying to finance.

If that long contract does not reveal the fact that you financed the extended warranty you need to take that contract and fax it over to your lender and show the lender that maybe there is some payment packing going on which is against the law.

Now I'm sure that the contract reveals the interest rate that you're paying on that car loan. What many Finance managers will do Is get you to agree to a dentist right let's say 10%. Then they will personally take your credit information and put it in a special program that shoots all of your personal data to as many lenders that they have embedded into their computer. Next they will try to find a lender that will give the lowest rate possible.

Let's say they find a lender that will approve a loan of only 5%. Now you sign a contract agreeing to 10% interest. There is what's called a five point spread that difference goes from the lender directly to the dealership. So if you agreed to 10% Interest loan And the dealership got you bought at 5% The dealership will not reduce your interest rate to the 5% that they got you approved for. It's called back and gross / Profit for the finance manager who got you to sign all the paperwork and bought everything that he sold you.

If your contract is not reveal that you brought an extended warranty and you put nothing down that means that extended warranty was financed. If that contract is not reveal the extended warranty in the paperwork the bank is a victim of payment packing and they do not like that.

I wonder if you are willing to Google the company name of the extended warranty ? I am willing to bet you'll find many complaints of other consumers that do not like the name of the extended warranty that you were sold. 

Go to Google and type in the extended warranty company name and the word reviews Then you will be reading other people's complaints about the extended warranty trust me it always pays to do your homework before you buy anything.

There is no finance company on the planet that requires you to buy an extended warranty and if you don't you won't get financing many finance managers tell customers that all the time. Many finance managers like to play sphering your head but if you do not buy the extended warranty that your car will not get financed that is bullshit. I am willing to bet money that the name of the Extended warranty company is allover this website !

Think of this mini extended warranty companies will run a customer through the ringer when a customer wants to cancel the extended warranty policy. The reason they do this is because they don't want to piss off the dealership because the dealership is selling the extended warranties to you. Extended warranty company love the dealerships they really don't care about you and you'll find that out very soon when you try to get your car fixed.

If you have not paid for the warranty do not pay for it because you Not get 90% of your money back. You will have a loss trust me I know what I'm talking about.

As far as your complaint to Kia motors Corporation good luck they love the dealership more than they love you. The dealership is money in their pocket you don't. 

General managers do not like to talk to unhappy customers because the only way they can make it unhappy customer happy to get some money back and they don't want to do that. When you buy a car your money instantly goes into a one-way pipeline don't expect money to come back to you. 

The part where the finance manager tells you that you have to pay for the program and then wait for a refund but he's trying to do better than likely is to lock you into the deal which puts profit into his pocket and then when you try to get a refund you will not get all of your money back. You will lose up to 30% of the price of the extended warranty. Maybe even more.

What is the name of the extended warranty company that you brought this policy from ? By the way how much did you pay for this extended warranty ?

Did you buy any credit life disability insurance and if you did how much did they sell that to you for ? 

Mini dealerships put the people with strong ability to take hold of the customer and take control their customer and can sell them anything they want they will take that person and place them in a finance department because that's where the larger percentage of profit is created. If you buy a brand-new car they do not make a lot of money off of you.

When you buy a new car you could ask to see the invoice so you can negotiate profit not the price. When you buy a used car you cannot ask to see the invoice cause there is not one. That's why many salespeople do not want to sell you a new car because you cannot ask to negotiate the profit of the used car because there's no such thing as an invoice and it will never tell you to show you what they paid for the car that you plan to buy that used.

And trust me I do believe that the general manager and the general sales manager do not want to talk to you because they do not want you to cancel the extended warranty. 

I tell people all the time never buy a car from a salesman that you like if you buy a car from a salesman you like you're putting yourself in what I call the unsafe comfort zone. Never buy anything in the finance department from somebody that's trying to get you to like them it's not about friendship it's about money. If you like them and they know that they will be able to take more of your money away from you. The reason for that is because they know that you like them and that you have no intentions of going to another dealership down the road.

 

Many dealerships don't care if they only sell you one car and that you never come back again. Many sales people are trained across the country that if they don't screw you somebody else will. So they feel it might as well be there so they can put money in their pocket. Trust me I would love to know the name of the extended warranty company and I would love for you to go to Google and do some research regarding the extended warranty company name.

Please tell me how much did you pay for the extended warranty ? By the way are there any other rip off reports on this website about this dealership or this extended warranty company ?

I'm very sure that the finance manager was not happy that you wanted to cancel the extended warranty because if you did that you would be taking money out of his pocket.

It is very important that you notify the financial company that is financing your new car and let them know that you bought an extended warranty if you've financed the extended warranty. 

Did you buy window tent ?

Did you buy credit life disability insurance ? Did you buy tire replacement insurance ? I would love to see the list of things that you bought from the finance manager.

What kind of interest rate did they charge you ? Ask him to show you what the pyruvate was on your deal in other words the information that Linda sent back to the dealership and told them what they would do the loan for. 

Remember if they got you bought on the interest rate of say 5% interest And whatever you agreed to on the contract I'm sure was much higher. So if you agree to 12% and they got you bought at 5% where did that difference go ?think about it !

Many years ago when I bought a car from a Chevrolet dealership and I found out when I was a kid and I got screwed I went to a local drugstore and about me some white shoe polish and I wrote on the sides of my car that I feel my dealership and I mentioned the name sucks Then I went to the dealership on a Saturday morning and slowly drove my car to get parking lot their customers see it.
